Not following safety procedures, using a "What are the odds"? approach to safety. I hope they find him guilty, assess the full penalties, and forbid him from operating boats of this type again, and hand the remainder of his debt to his descendants to be responsible for. There are serious penalties for trumping of this caliber.

I've been on a Duck boat twice, while visiting New Zealand. It was a heck of a lot of fun.

I think they had a couple of "Captains", who probably had some additional credentials for on the water and several drivers. The Captains stayed at the ramp and when the boats drove up took over for the water operation. I know they had several of the Duck Boats and using this method would let them keep them all operating the tour part with (probably lesser-payed) drivers and just use the Captains on the water.
I have a business contract that requires me to spend one day a month in Branson and before the accident I would see a lot of these things running around.

I've never ridden the Ducks in Branson, but I have been on the Branson Belle and saw the Ducks on the Lake. I really enjoyed the Brason Belle and recommend it highly.... the Ducks not so much.

We rode one of them, the next day we went on the Belle.

Rented a boat to go fishing, it died in the middle of the lake with the Belle headed straight for us.

Got the marina on the phone, guy came out & fixed it, we got another hour for free.

There's a whole bunch of Ducks sitting on the bottom off Normandy, they didn't do so well in rough water.
We'll never ride one again.

Sounds likely. A USCG master's license is not a trivial thing to acquire (720 sea days and most have a 4-year degree), so you'd not want to waste one just for driving a glorified bus. Legally, the driver can stay at the controls - the captain is present and in charge, he doesn't have to be involved in operating the craft at all. Sounds sweet, but the flip side of that is that he's legally responsible for judgment calls. There's no directive anywhere saying "You can legally sail this craft under these specific conditions", it's the captain's responsibility to apply his knowledge and expertise, every single time.

I know at least one person with a 1600 tons USCG master's license who only sails as First Mate, just because she doesn't care for having that ultimate responsibility.

Did the duck tour in San Diego, San Francisco, and Seattle. It was a pretty fun way to see the cities. I don't know if I would try it in Branson motly because I can't imagine what would make me find myself in Branson.

I pilot a tour boat , i cancelled trips on 2 different days this season because of developing weather. One was a bust as the storm headed away from the area. The other hit hard, an hour deluge with a lot of electricity involved, i stuck around after i cancelled. Some passengers were irate but i told them to take a bit of your refund, buy a beer and hang around for a while and let's be glad we're dry and not potential lightning targets, and enjoy the show with me. They agreed with me wholeheartedly once the weather really got cookin'. Some returned for a later tour, the calm after a big storm is absolutely perfect for a tour.
35 years around here, i can read the weather just like a book. (Inland lake so state of california licensed, not coast guard jurisdiction)

Not sure, research doesnt reveal exactly who. Admiralty law comes into question, workboat.com had an interesting but unconclusive article on that very subject...
