Well, that cost tens of thousands of dollars, and hours of law enforcement time.
But at least I can sleep at night, safe in the knowledge that someone who uses a drug I don't like is locked in an expensive cage.

The way they do it in Kentucky at least, is that if they find it after they ask you, you get hit with Contraband charges (i.e. trying to smuggle contraband into a jail), which is a felony ON TOP of whatever the charges are for the item (in this case, it would be a misdemeanor Paraphernalia charge). . .but if you hand it over when they ask, they just hit you with the charge for the item.

So yeah, the charges are less if you hand it over (around here at least), but people get the "bright" idea of trying to hide it and think they can get away with it.  The new body scanners they use at most jails around here in lieu of strip searches find pretty much everything though, to the point that most offenders (at least those with any "experience" now just hand it over, because they know the scanners will detect it).

That's like when you show up for Basic. The drill sergeants give everyone a chance to dump drugs etc in the amnesty box. Being new, a lot of us thought it was a trick. But there was some dude who went back there for about 5min, and nothing happened to him. Why would you bring contraband into reception, especially if you didn't know about the amnesty boxes in advance???

It's more the mens rea.

If you enter a place willingly, especially an army base days or weeks after signing up to go live there awhile, you've chosen what to be there. Any contraband, and I've seen the signs and amnesty boxes, you bring is something you intended to bring onto the base. That IS smuggling.

But if you're arrested, it's presumably against your will. Anything on, or in, one's person was there for their personal use and not to be brought into a jail.

It's not constitutional for police to force you off of a public street, drag you into private property, then bust you for trespassing. This likewise should be something they aren't allowed to do.

That mug shot is horrible. I work in criminal justice system and watch first appearance hearings to make me feel better about myself. The best is when I see another woman my age (42) who looks 100. Then I say to myself no matter how ugly you are at least you don't look like that.
