The witness raises legitimate questions, but his concerns are not legally sustainable. The scope of the Special Counsel's power falls well within the boundaries the Constitution permits, as the Special Counsel is supervised by an official who
is himself accountable to the elected President. The witness's remaining arguments fare no better. Multiple statutes authorize the Special Counsel's appointment, and the official who appointed the Special Counsel had power to do so. For these reasons, explained in further detail below, the witness's motion to quash the grand jury subpoenas is denied.

Miller was ordered to appear before the Mueller grand jury last week after a federal judge rejected his attempt to quash the subpoena on the grounds that Mueller's appointment was unconstitutional. The judge wrote in a 93-page opinion that Mueller's appointment was valid.

The inquiry is valid, and a judge already rejected his motion to quash. So issue a warrant, Judge, or he will continue to piss all over the court system

Judge let him stay out of jail while filing the appeal. I wouldn't have, should have gotten the appeal in before you were due to show.

That would have been more satisfying, but I fear it would have been used as further fuel to the complaints about the "very unfair treatment" Trump's co-conspirators are receiving.

Not saying that not doing it will assuage those complaints, but I'd prefer to keep as many of them grounded in total bullshiat as possible.

They all get a few jack holes like that every year or two. I know one who gets really courteous, very solicitous. Let's them argue forever without cutting them off and so on.

The regular lawyers see the signs and start edging away from the nut because, you know, when the lightning bolt finally thunders down, the blast pattern will be wide.

That's when he filed his motion to fight the subpoenas. In a closed hearing Friday in a Washington, DC, district court, Judge Beryl Howell found Miller in contempt and then stayed that ruling until this Monday to allow for an appeal to be filed."

FIVE, count them, five times he ignored subpoenas and she stays her contempt ruling until Monday.  You and I, they send a marshal and we go to jail after the first or second failure to appear.

It is always fun (or at least interesting) to see the attorneys who act as local counsel for big firms start to back away from co-counsel who are about to get the lightning bolts and thunder. When you see law clerks and the Marshall start to back away you know it is about to happen.

You can try to duck getting served a subpoena, but once it's been served, you'd best not ignore it.

There are few agencies and people you just don't want to piss off because of the power they have to screw up daily living. A US District Court Judge is high on the list, the FBI and IRS are on that list.

My understanding is that any documents were gathered by legal means, even if it's the case that Mueller's investigation is cancelled, and the DoJ or Congress can just authorize a different agent by some other means to complete the investigation.

If the person you were arguing with was a Trumper, chances are they're wrong. There's a 93-page document linked in this thread that basically says Mueller's appointment is Kosher.
