I'm from about three blocks from there.
Bay View is not a town, Bay View is a neighborhood in Petoskey, which is a town.
I liked those people being segregated in their own little douche-bubble.
They don't even plow those roads in the winter.

so what I'm saying is f*ck Bay View anyways.

Personally, I would not want to be the first non-Christian person/family to move in there. Guessing it's either going to be passive aggressive sniping, blatant bible-thumping, or something uglier.

It won't take long for the money factor to win out and people realize that this means their houses are worth a LOT more.

Ocean Grove, NJ tried this for the longest time, but it took a delivery man getting a ticket for driving through Ocean Grove on a Sunday to reveal that the Ocean Grove Camp Meeting Association had a bylaw saying to be a voting member, you had to be a good and upstanding member of the Methodist church. They got slapped down by the Supreme Court which took away their court, police force and lawmaking powers. The town got handed over to Neptune Township and became an unincorporated community, though the OGCMA still technically "owns" the land and gives out leases to allow them to dictate that section of Neptune a dry town and to deny homosexuals the allowance to get married in the beach gazebo.

Sounds to me like it is a local governing body, especially since they have policing power. That makes it government, which is clearly bound by the 1st amendment to make no law abridging religious freedom. That means there can be no requirement for a persons religion of any sort, including for seats on the governing board. If they take on governing responsibilities then they must follow the laws too. Obviously just needs someone with deep enough pockets to handle the legal battle to take care of the problem.

Agreed. I'm from downstate but we have family in Boyne so we're regularly around the area. There was a little restaurant that we stopped by in Petosky (JB's?) and there was a group of those wackadoo's eating there. They were talking the Bible and doing it so everyone around could hear. One of the older guys (60's maybe) started berating my 12 yr old daughter for wearing a Metallica t-shirt while she was on her way to the restroom. I promptly got up and let him have it in front of their entire table. Some of the group looked like their ears were gonna melt from hearing the words that came from my mouth. The server ended up coming over after we sat back down and just kinda smiled and said "my manger would like to comp your breakfast." They didn't need to do that but I do enjoy food, especially free food.

HOAs are local governing bodies, but have more carte blanche to restrict 1st Amendment rights than legitimate governments do.

So if the rules of my private organization allow me to sell cocaine and have sex with underage teens I'm ok then?

Yep, but they do their damnest to make you think they do

Little-known fact: When HOAs first popped up, it's main focus was to band together and keep all non-whites out of their neighborhoods

Perhaps this will help everybody:

Deed Restrictions Law and Legal Definition
Deed restrictions are private agreements that restrict the use of the real estate in some way, and are listed in the deed. The seller may add a restriction to the title of the property. Often, developers restrict the parcels of property in a development to maintain a certain amount of uniformity. A deed restriction is a clause in a deed that limits the use of land. However, restrictions that are against public policy are unenforceable, such as those that prohibit people of certain ethnic groups from using a property. Deed restrictions placed within a deed control the use of the property. The restrictions travel with the deed, and cannot generally be removed by new owners.

Where I live, we don't like children.  We can't expressly say "no children" so we make it very difficult for children to live there with lots of rules in the HOA bylaws.  This has successfully kept children out of our neighborhood for 20 years.

You can say "no children" in a  "55 or over" over community. It's specifically allowed in the Fair Housing Act.

Votes to "let" them in? Were they stopping all the vehicles at the city limits and checking them for Muslims with, like, dogs and those metal telescoping rods with a mirror on it, just in case a Muslim family was hiding under a truck?
