Some consolation:
As he was likely moving at a good clip (enough to break his neck), he probably never regained consciousness, so there wouldn't be any "shiat, I'm paralized and can't breathe, one of you drunk farks do mouth-to-mouth!"

I'm guessing he just dropped and didn't move again. You're just not 'officially dead' until you're in hospital and dead. They only pronounce on the scene when there isn't ANY chance of survival e.g. no head.

In the UK only a doctor can pronounce death, but parameds can stop when if they decide the circmstances merit ceasing of life saving activity (patient bled out, no response despite all best efforts, head detached from body etc).

The waitress is likely going to be charged with manslaughter, in that she did not do enough (anything?) to try & prevent what a reasonable person may judge as being stupidity likely to involve serious harm or death to the drunken slob in question.

I hate how someone can be charged with a crime, just because they didn't get in some idiots way of furthering evolution. If some asshat wants to jump off a bridge, I'll just keep on walking by and let him. Its not my responsibility to stop people from doing what they want. Now, if that same person were trying to take another with him (EG Murder / Suicide), thats another story.

There's a big difference between ALLOWING someone to do something dangerous and ENCOURAGING someone to do something dangerous.

Confoundit I'm not just talking about this article, but it applies here too. This woman (based on the article) did nothing to make this man run into the wall, she just encouraged him too. Just like I can encourage you to stick a knife in your eye. Odds are though, you're smarter than our friend Gerhard Renzl here.

My point is, if your dumb enough to get SO DRUNK that you're willing to pull shiat like this, it doesn't matter WHAT people are goading you to do, its still YOUR FAULT, not theres.

Let me put it another way, peer pressure in school is a big thing right? Really hard to resist to it because if you do you wont be cool, and so on and so forth, so alot of people give in and conform. Its not your Peers fault that you conform though is it, its really yours, because its YOUR choice.

Really, then release all the prisoners who were impaired when they committed their crime. If being impaired is not a valid defense in those cases--it doesn't apply to this.

Ok She Who Waits Let us consider a hypothetical situation to make it more clear.

What would you say if the person running into the wall was not drunk at all but instead legally mentally impaired/ill. Our hypothetical person is not fully able to understand what they are doing and the consequences of their actions. A woman, who realizes and can see that the person in question is not fully mentally competent, convinces this person to put themself into danger, and they perform an action that results in their own death.

There is no question that in this hypothetical case the woman has done something wrong. The difference between the hypothetical and the real cases are that the man elected to put himself in a state of mental impairment instead of being involuntary. However that is not enough to justify the woman's actions or relieve her from the crime. Once he is in the state of mental impairment, in a bar that is designed for that exact purpose, it is the responsibility of those in the bar not to take advantage of the man and cause him harm or death.

If a drunk woman can rightfully claim rape due to alcohol impairment and win the majority of the time, then the action of encouraging/convincing a guy to do harm to his body is most certainly a crime. I'm sorry if you can't or refuse to see that.

it was the asshat's own fault for trying out the stunt. Even when I'm wasted I have enough sense to know what stupid ass things I could do could kill me. And this guy gets bonus stupid points for reenacting a Jackass stunt. That show is one of the worse things on TV.
