Lol, okay.  The U.S. is pretty lax about VISA overstays.  More so than much of Europe.   If this is "uncool", then Europe has been extremely far iunto the uncool zone for decades.  I knew a lot of people on VISA in college that overstayed for years even decades after graduating.  There's virtually no penalty for doing do.  Try that in Germany or Switzerland.

You joined the ranks of my favorites today by comparing the Politics tab to the Gom Jabbar, so I hope you'll take this in the spirit of goodwill with which it is intended, but if Mrs. lostcat is a visa holder, I'd be a little leery of posting a pic of her holding an AK-47, given the current hostile climate of ICE and the other state-sponsored terrorists of "law" enforcement in this country-gone-mad. Just my friendly two cents, which, admittedly, may be a tad too paranoid for most normal people.

Anyway, it's knew, past tense.  College was 25 years ago for me.  The last overstayer I personally knew went back to Italy 3 years ago.  She knew all along there were no jobs and nothing but male sexism waiting for her back home - but yeah U.S. is horrible yadda yadda, I know, and she would tell you different.   But no it's not that unusual.  The feds estimate an annual 700,0000 people who ignore VISA time limits per year.  What made you think it's so rare?

They have been monitoring social media accounts for almost 10 years, both prospective and existing, I'm not sure what has changed here. Maybe the technology

Knew one girl "Coming to Colorado, looking for a job!"
Popped at the border "you know you're on a travel visa that doesn't allow work?"
Girl "Who, me? Whaaa?"
ICE "Yes, here is where you said it on FB. Log into all of your social media and Gmail or you can turn around and go back"

And they let her stay. She was from Europe, however

So if your married then does she not qualify for naturalization at least? I hope you both have a long and happy life together and that she becomes a citizen if she so desires. If she is not overstaying her Visa then none of this should impact her or you IF ICE even decides to pursue this.

As an immigration attorney even I haven't met a lot of people who have overstayed their visas by decades. A few, not a lot. Most people who do get married within a few years and then they are no longer overstaying their visa because they get a green card. I was just wondering why you knew a lot of people who disclosed that they overstayed their visas to you, and then who kept in touch with you for decades. Why do I think that's rare? Because that's not the type of thing that people advertise, and keep advertising for decades while still doing nothing to correct their status. And yet, you knew a lot of people who did. It's definitely weird.

Because I was friends with them?  I was a hard sciences student.  And foreign students coming to the U.S. to study tend to cluster in STEM fields.  Not as many come here to study Women's Studies, Journalism, or (American) Law .  In some science fields they almost outnumber American students.  So I was probably among far more VISA students for years than you are, perhaps, remembering from college in a non-science major.   And when you work in the same industry you tend to keep in touch at least professionally.

I knew two who were in the more than 10 years catagory.  Both from Italy (but unrelated).

Yes, but there's a couple questions here - what if a tourist, student, or temporary worker refuses to disclose their social media account or says they don't have an account - or even legitimately, don't have an account to monitor?

Then there's the presumption of guilt issue. If a visa holder has done nothing wrong yet, why should they be subjected to state observance of their little notes to friends and family? Right to privacy used to mean something.

Then there's the sheer manpower involved in getting a bunch of jobsworths who's duties are to monitor and maintain a database of these accounts and seriously we're going to pay guys to look at pictures of what someone's having for dinner for as long as their visa lasts? Isn't there a more productive way to do things?
