I don't think anyone's arguing that they SHOULD have done what they did. I don't think anyone's arguing that what the did wasn't wrong. I don't think anyone in any of these posts so far are excusing their actions.

Sure. That would warrant an investigation as I'm sure it has. Charges to come if they find anything.

But right now it appears that they're slapping them with some charges that they believe fit without considering the actual situation and how this should be handled.

There is in-between, you know. That's exactly what troubles me. We're ready to nail everyone to the wall without really thinking it through.

Which is fine and dandy until you or I get caught doing something we should have thought better of. Then it's us getting nailed to the wall while pleading that it's not as bad as it looks. Losing our jobs because we went to jail for what amounts to joking around, albeit extremely inappropriately.

Neither you, nor I know what the police uncovered, or how much they investigated.

I offered up a plausible explanation for the seemingly over-the-top move of charging them as a possibility.

Technically, they are guilty of the crimes they are charged with, based on the video evidence. There isn't really any other explanation needed, of course. Your or my idea of "reasonable" has no effect on the outcome. In that light, this is no different than making bomb jokes at the TSA checkpoint... sure, it was dumb and probably not intended with malice, but you are going to be spending time in legal hell getting it resolved.

At the end of the day, their case will be heard by judges, and they will likely have lawyers to defend them. Maybe their cases will be deemed as legal overkill and they'll be let off. Maybe not... shrug... the easiest way to avoid going through this sort of mess is to stop doing stupid crap.

I think criminal charges seem a little over-the-top, now they are just going to end up a drain on society for the rest of their life.  Definitely, they should have been fired for gross stupidity.  And as a lesson to the rest of us, remember that you do stuff all the time that the cops can twist into some sort of criminal charge if they have a mind to.
