Coincidentally, University of Phoenix gives automatic acceptance to an 800 SAT.

It's amazing.  I went through college as a mostly conservative Republican.  Graduated about a decade ago.  It wasn't until Trump ran for President that the indoctrination from college finally kicked in.

I mean outside the really expensive and or narrow majors.  Our liberal arts colleges in particular seem happy to let anyone bury themselves in debt for an education that won't really help in the end.  Even at that you can find a couple places to go unless you do really badly on act/sat in which case you're better off not going to college anyway.  Of all the immigration issues this one is about -11 on the 0 to 10 scale of things I wonder/worry about.

my BIL got into University of Chicago's phd program because he has some personal relationships where he did his masters who knew how to leverage the fact he's Mexican. It's been pretty hard on him actually because he feels he it didn't really earn it which is a big big freakin deal to him. He's pretty naive having spent his entire adult life in academia. I told him "look, you better play every advantage you have and you better create advantages for yourself you don't already have, otherwise, in the real world, your arse is in a van down the river" but he's still pretty hard on himself.

The whole thing makes me conflicted, see affirmative action as just another form of discrimination. I'd hate to be the administrator that has to tell some kid "hey look, you meet every academic and financial requirement to attend this school but you're just the wrong color". On the other hand, if you have an advantage over the next guy/gal then you better.farking.use.it.

If you are a 2400SAT, 36ACT, with all honors and APs on your transcript and a diverse extracurricular life, you will not be passed over for "diversity" students. Most state schools will give you a full tuition scholarship just for acing one of the standardized tests.

Again, find me someone that thinks they were "passed over" as a white student with an impeccable academic record and I might buy that argument, but it's always some middling student with with a victim, never-my-fault personality that ends up shouting that some "colored" took their spot.

My friend came to Japan legally, earned a PhD from Japan's top university, is married to a Japanese citizen, and publishes academic research in Japanese frequently. Still, they have get that work visa renewed every single year.

Surely everybody knows this, but just in case: DACA didn't "legalize" any of its recipients, it just made them eligible for potentially indefinite deferred action while allowing them to work. It also didn't provide them with a path to citizenship - it was always going to be tentative. Unfortunately these were the limits of doing things via executive order and not actually changing the U.S. Code.

Why should you be conflicted? White males have had their own affirmative action from legacy programs and scholarships through outright fark-you discrimination from before there was a country, and I'm sure not a gad-damn one of the people that got ahead by using these methods felt one tiny bit of guilt, remorse, regret or sadness that they were able to get what they got because of the color of their skin or ethnicity.
They probably though they got ahead because that's the way things were supposed to be, and many still think this way... that's why little asswipes like this whiner chose to report this young woman. The entitlement mentality is still strong with people like this guy.

Such small and rare advantages that exist for people of color - still dwarfed the way things have been forever that are mentioned above - have only existed for a little over half my lifetime. I'm old enough to remember when even newspaper want ads for jobs were segregated by race and by sex. Wasn't that long ago.

Damn right people of color should use whatever advantages they can get to get into school... because once in school they still have to do the work and measure up academically. And there should be no guilt or conflict involved what so ever.

He is getting sued by states for not deporting these people.
Congress has had 5 years to do something about DACA, and have done nothing to keep these people from being in a state of limbo.

I don't feel that good about affirmative action programs, but frankly they are a TINY TINY factor in the competitive admissions issue.  There are 100 times more foreign students that are competing with White Gomer, and they are on perfectly legal student visas.

That was the entire argument of the plaintiff. That her scores were as good as other students accepted at the school. The only difference she argued was that RACE was used as a metric to enroll other students instead of her. The school never argued against that point. They merely argued that they had an interest to have a diverse student body. So you are argument is dumb.

And of course it is always going to be students on the edges of enrollment who bring suits As they are the ones that get passed over by an ever shrinking set of criteria.

DACA is current US policy. It has been ratified, albeit temporarily, by the current president. So people who are qualified for DACA are actually not subject to deportation; by your own definition they are not "illegal".

Adults who entered this country undocumented entered illegally. DACA recipients did not. That's why they have a protected status. While it is arguable that there must be a change in the laws for DACA to have legal effect, that would have to be raised in the courts which it has not. So as it stands, DACA recipients are lawfully present in the United States.

Intent isn't always specified in criminal statutes, but it is implied here.

I think the crime for someone here who unlawfully overstayed their visa is the act of overstaying the visa; your intent is formed when you knowingly remain in the country past the time the visa expires.

I'm not an immigration lawyer, but it would be interesting to see if there is a case out there where a person is hospitalized or otherwise incapacitated for a period of time which places them in violation of the statute involuntarily. They would obviously be subject to deportation, but the question here would be whether they are criminally liable. I doubt there is such a case, but it would answer the question of intent.

Either way, that is kind of the point of DACA, no?

That's not at all what I'm arguing. I'm saying when it comes to the affairs of the middling, it's very easy to say that someone who was white and went to a private college prep school and graduated with 75th percentile scores is less of a candidate than someone who was black and went to an inner-city school and graduated with 75th percentile scores. The rationality exists that the members of the subjugated racial class have to work harder just to achieve parity in objective scoring metrics, so AA benefits them by saying that their scores are weighted more heavily than the white students.

This is one area where The West Wing nailed it:

"Grading is based on past performance, but admissions should be based on potential, on how a candidate may thrive with this sort of opportunity, and studies show that affirmative action admits have a higher predisposition to contribute to society."

The fact is that the only people butt hurt about AA are those people who don't believe there are systemic disadvantages ingrained in our system that need to be rectified in affirmative action, thus the name.

Probably, but it's not just about test scores.  They also look at course load, letters of recommendation, life experience, and essays.  If you want to make it into a top tier law school with below average numbers, you've got to impress in other areas.  She didn't.

"Deferred action" is not the same as "legalized". It's important to recognize the distinction - successful application results in a gratuitous promise from USCIS that the U.S. won't take action against the recipient. Enforceable in court? Don't know because the government hasn't tried to pull the rug out yet.

But at the expiry of the deferral period, the recipients are still left without citizenship or LPR status. They're not "illegals" but they remain "undocumented". Explaining this future uncertainty to people applying for it was difficult, especially since they're putting themselves on the radar just by applying. It was always a temporary solution to an ongoing problem.

Anecdote: I have been an international student in Texas. I'm European and I speak Spanish, so the only people who had a problem with me were the die-hard MAGAists. Their only success was to get me removed from a design contest that I won, whose prize was doing some work at Johnson Space Center over a summer. The runner-up was a US citizen, so she went instead. We're friends, so I did not begrudge her this.

Then there was the thing with the trigonometry exorcism and the thing with the time I tried to rush a frat and it ended up in a few thousand dollars in towing fees, but so it goes.

SSNs just mean you can be taxed. Fictitious persons have SSNs.

It's been pretty hard on him actually because he feels he it didn't really earn it which is a big big freakin deal to him. He's pretty naive having spent his entire adult life in academia. Plus colleges have a point when they say that a diverse student body has value in and of itself. Many businesses have realized this too. Different socioeconomic backgrounds. Difference races. Different nationalities. etc. They bring different perspectives to the table and that's good for education.

Did they change the GPA scale in the SAT score? I thought of 4.0 was the highest and the highest SAT score was a 1600? Where did they find ways to allow people to inflate what they actually do?

Uhhh....  DACA residents have to pay taxes.  They aren't eligible for Medicaid, but they can get tax credits of they qualify for the marketplace.  They also HAVE TO PAY FOR SCHOOL.  They aren't eligible for federal student aid because they aren't citizens.  Some states provide state aid, which is still a loan, some private institutions either provide loans or charge them as international students so they end up paying more....  Some get grants aloe scholarships...  If they meet and earn the criteria.

So what money are you talking about that we should be giving to actual American citizen??  They money that they've earned that gets taxed should get taken and given to them?  I'm really confused about what money you're speaking of.  The student aid money from the states that is earmarked for student aid that is a loan that has to get paid back?  We take that away we're also taking it away from US Citizens.

Or are we finding the loans that have been offered to the DACA students and then taking that and giving it to the citizens?  Who is paying that back?

Agreed. The University board should have known that her status meant that she was not here illegally, and that Taylor's post was factually wrong and potentially legally actionable.

My only worry (beyond her continued harassment wtf horrible people) is that if our President renders DREAMer status illegal, she becomes a high-visibility target for deportation.

She is not an "illegal". The status that this slur is imputing to her is inaccurate: what is typically meant by branding someone an "illegal" is that they intentionally entered the country without documentation, which is a misdemeanor.

Children (or in this case an infant) can't form intent, so she did not commit an offense when she was brought here. Moreover, the illegal act is entering the country, not remaining in it. So put simply, she never did anything that justifies calling her an "illegal".

Intent doesn't apply to the fact of having entered.

The child might enter without breaking the law if the parent came through an immigration entry point and was let in my immigration agents without the parent willfully misrepresenting material facts. DACA is current US policy. It has been ratified, albeit temporarily, by the current president. So people who are qualified for DACA are actually not subject to deportation; by your own definition they are not "illegal".

Adults who entered this country undocumented entered illegally. DACA recipients did not. That's why they have a protected status. While it is arguable that there must be a change in the laws for DACA to have legal effect, that would have to be raised in the courts which it has not. So as it stands, DACA recipients are lawfully present in the United States.

So according to your logic if my parents take me into Disney illegally I am allowed to stay and ride rides because the guards are ignoring my presence ? 

They were here illegally and an avenue was created for them to gain legal status with a temporary stay on the deportation process. They werent suddenly legal immigrants they were in limbo.

It's not black and white, and yes it does need to get fixed.  The problem is that people who were brought here illegally as children and grew up as Americans don't know their home country.  Sending them back would be like you being sent back because your forefathers entered illegally.  Don't know where you're from, but getting sent back to Germany for me would be rather difficult.

And illegal immigration isn't a crime.  It's been held up by SCOTUS.  Is a civil matter.  So they're not criminals.

Personally we should fix the immigration system, and make penalties for the parents who do bring kids in illegally, but at the same time not make the immigration system a convoluted nightmare so people wouldn't feel the need to enter illegally.  At the same time we shouldn't punish the kids of these people who know no other country then the US.

Seems to me word games are at play. Yes, there is a thought that actually "being" in the country is more a civil violation (as in over staying a visa) , the term "illegal" still applies. For example, a parking ticket is a civil violation but it is still acceptable to say someone is "illegally parked" and thus got a ticket. Both situations are subject to action by authorities whether it be deportation or a parking ticket.

As far as "intent"...I agree, you can't arrest a someone for purposefully crossing the border illegally when they were an infant. However the civil punishment for being here "illegally" still technically applies...which is deportation.

It also didn't provide them with a path to citizenship - it was always going to be tentative. Unfortunately these were the limits of doing things via executive order and not actually changing the U.S. Code.

But at the same time, they have SSNs, can get driver's licenses, and they pay income taxes.

SSNs just mean you can be taxed. Fictitious persons have SSNs.

Similarly, a driver's license is simply that -- a license to operate a vehicle on public roads. They don't indicate citizenship.


Legal entities have EINs not SSNs.
But driver's licenses and social security numbers are things that illegal aliens don't have, and can't get (for the most part, 12 states do have a driver's license for that the undocumented can get).
Dreamers have a provisional legal presence that can be revoked.

No. Not a word game. "Illegal" and "unlawful" aren't exactly synonymous.

Per Federal law, "Unlawful presence" is a civil violation while "Illegal entry" is a crime. One is a state of being while the other is an act.

Most undocumented immigrants entered the country legally on tourist visas, work visas, student visas, etc. and simply didn't leave. Most Dreamers had zero say in, or control over, their presence in this country. Their average age when they were brought or sent was 6 years old. When I was six, I had no choice where I lived either.

It's not ok to tell a prospective student "the reason you can't attend this school is because you're white" just like it's not ok to a tell a prospective student "the reason you can't attend this school is because you're not white". I don't see much wiggle room there honestly.

Most high schools weigh honors or AP courses with a higher possible GPA. At my high school, an AP/Honors course was worth 4.5pts vs. a normal course at 4.0. Between my junior and senior year, I took AP Calculus I, AP Calculus II, AP Physics C, AP Chemistry, AP Biology, AP Computer Science, AP US History, AP US Government, AP Spanish & AP Studio Art among other non-honors courses like Photography and Studio Art. 

As such, nearly the top 20% of our school graduated with an accumulative GPA > 4.0.

In college, this doesn't really happen, but in high schools, it absolutely advantages those children who choose to take the most challenging course loads they can.

This is correct (AP classes awarding more grade points).  As for the SAT, they added a composition/long form section.  Without that section it is still maxed out at 1600, with that section added I believe it is 2400 max.

The difference here is that I can bring up quite a few examples of prospective students being told - out loud and in public, by elected officials no less - that they cannot attend a school because they are not white.
I have yet to see the reverse. If you have links to this, I would like to see them.
And this is not about telling white people - who also happen to have been at the top of the historical, financial and cultural food chain in this country since before its inception that "they cannot attend" anywhere.

Imagine a line of people waiting to get into an auditorium. Before, all the people in that line would be white, with people of color not even being allowed to get in the line at all.
Later they were allowed to get in line but always at the back, with white people allowed to cut in ahead of them until the number of seats had been reached and again they could not get in.
Now that an effort is made to put people of color in the line so that they can get in, the white people at the end that exceed the number of seats complain that they should have gotten in anyway.

There's a sense of entitlement that still pervades these peoples psyches, to the point where some of them join neo-nazi groups and parade down streets with torches. They believe they should have simply because they have always had, like their fathers and their fathers before them.

So the question is this: where where these white people and their pleas for fairness when the first two scenarios were in play? Were they concerned that the people of color could not join the line? Were they fighting for the rights of the people of color that got pushed to the back of the line? The answer is "They were nowhere". As long as these people had the advantages they desired they saw no reason to rock the boat or complain that everyone was not getting a fair shake, and it's likely they did not even think about those who were denied or why. And now that they are experiencing just a small fraction of what others have lived forever, they complain.

So no, nobody's telling white people "you can't attend because you're white", because the real issue is the white people who assume that they can over anyone else. That's the assumption that has to go.

By James Comey's own admission, the claim that Hillary leaked classified and top secret documents and information properly marked as such at the time of authorship of the emails was validated. Comey also said that he did not recommend prosecution for treason, because that would require proof of malicious intent- something he says he could not conclusively provide. He also admitted:

"To be clear, this is not to suggest that in similar circumstances, a person who engaged in this activity would face no consequences. To the contrary, those individuals are often subject to security or administrative sanctions."

Having worked as a government contractor holding a security clearance, I can tell you what he was referring to. I was briefed that any spillage of classified or top secret data (the official name for an unintentional leak) was sufficient grounds for revoking my security clearance, although actual revocation was subject to a review process. Regardless whether or not my clearance was revoked, my contract would be terminated and dependent on the outcome of my review, I may be prevented from working as a government contractor in the future for jobs requiring a clearance. Naturally this scared me badly enough that I never once spilled data and became paranoid about making sure my co-workers didn't either.

What Comey was referring to was that a different person in similar circumstances to Hillary would have got herself fired, her security clearance revoked, and probably prevented from working in a secure environment again unless she could successfully appeal getting her clearance revoked. This obviously did not happen, despite there being plenty of precedent not that long ago with general Petraeus. Furthermore, Clinton and Clinton staffers actually still had clearance as recently as June. This is made even more surprising by lawyers saying in the press that a client would have been seriously at risk of losing their clearances in the same circumstances as Hillary over a year ago. So given all this, you sure you still want to pretend Hillary hasn't flaunted the law?
