Considering Florida has said its self-defense to drive home, get your gun, drive back, and then shoot the guy who was "threatening" you by being black and playing that hippty-hop music without even knowing you existed, she may have a case.

The word still would have been used five (or however many) times. It has nothing to do with the genetic makeup of the defendant.

A person is alleged to have done a thing until CONVICTED of doing that thing. Even podunk newspaper people are aware of this and will not state that "Jim-Bob Cletusson shot Billy-Bob Cletusson" until Jim-Bob is convicted.

News orgs would quickly be sued into oblivion if they did not take pains to indicate that so-and-so is alleged to have done X unless and until convicted.

The saddest part about this thing is, that even if this lady (to use the term loosely) goes to jail, this poor homeless guy is just going to be back where he started plus a few additional health concerns from getting shot (assuming he survives).  There's no such thing as justice.

After three assault charges the father still manages to defend the monster he raised.  I'm curious why he thinks she shouldn't have just driven away if she was being attacked.  I mean, unless he was a scanner, she'd probably be safe in a moving car...

Fleeing the scene after shooting someone in self defense is actually reasonable and rational.  You don't know the guy is dead, you don't know that he doesn't have friends that heard everything happen and are on their way to help.

Now, this leaving the scene also requires immediately calling the cops, informing them there's a guy bleeding, you did it, it was self defense, you didn't feel safe staying at the scene, and as soon as the cops show up you'll come right back so they can take your statement.

1. Just a bunch of BAE's hanging out in a dark parking lot like girls do.  At 3am.  With a 5 y/o child waiting at home
2. "She did not mean to hit him" because as any gun safety instructor will tell you, "when in doubt, pull your black market heat out".
3. The man was not a present threat. That is not to say that he had couldn't become a threat, especially if he had verbalized as much, however all you had to do was drive away and call 911
4. "One eyewitness in the front seat" finally, one of them accepted the hush money
5. Parking lots are not an ideal hang out. You're 26, go home and visit. Cut the dope up in the bathroom, duh
6. Prior assault conviction less than 5 yrs ago
But since homeless dude is most likely black without any family and probably has 10x the priors Miss ShootyMcShootface has, they'll show leniency. Homeless dude probably won't press chanrges anyway (think the DA will?  OH HAHAHAHHAHAA), so she'll pay a fine and everyone is happy. Until she" didn't mean to shoot" the next person.  There should be a Melton's law, where crazy biatches have to register for being crazy.  Yeah I know, it would take down all the internets...

Don't forget. 
You can walk in on someone robbing your house, the robber can drop what they have and run away.  You can chase them for 3 blocks, corner them, and force a confrontation.  At that point, you fear for your life and have to stand your ground and shoot the bad man.

Sometimes parents are in denial.  My younger brother is mentally ill, and my parents somewhat enabled him over the years.  I think they finally "got it" when he was arrested and sitting in jail, awaiting his trial.  (I don't want to get into the details, but I will say that he never physically harmed anyone....although that could have happened eventually.)

Now, this leaving the scene also requires immediately calling the cops, informing them there's a guy bleeding, you did it, it was self defense, you didn't feel safe staying at the scene, and as soon as the cops show up you'll come right back so they can take your statement.


She got out of her car to yell at the guy, then was half of an escalating  screaming match with a homeless guy and when he didn't back down she returned to her car, got her gun and tried to murder him.  Maybe she was afraid of the consequences after she shot him, but at no point before leaving the scene did she act like someone who was at all scared, she acted like an opportunistic predator.

Well, the typical self defense round usually cost $1-1.50 per round. Since she shot him twice, let's just call it $2.50. I filled up my gas tank yesterday at $2.35 a gallon. So, in conclusion, a gallon of gas would have been slightly cheaper.

Now, this leaving the scene also requires immediately calling the cops, informing them there's a guy bleeding, you did it, it was self defense, you didn't feel safe staying at the scene, and as soon as the cops show up you'll come right back so they can take your statement.


It was stated that she actually "drove back to drop her friend off at her car and that she was surprised" to see that it had turned into a crime scene.

Like I said, you've obviously never been robbed. It's not about the possessions(although my wife may say differently after some pillhead stole her great grandmother's engagement ring along with other things). It's basically a rape of your sanctuary in this world, and if you can't understand why that is worth protecting, I don't know what to tell you. While waiting for the bus maybe back in February or March of 2016 I was having a smoke when a (non-homeless from appearances) guy walked up and asked me for one. Taking out a cigarette at a public bus stop is almost as bad as opening a bag of Skittles in elementary school because you're going to get swarmed like an amateur white housewife in a BBC hotel gangbang shoot.

I don't mind handing out a smoke but they add up so the standard price at least here in Ohio seems to be fifty cents for a bummed one. I don't think anybody had asked me yet prior to one fellow wandering over but since the fellow couldn't even be bothered to say "please" I said I needed fifty cents for one. He started biatching and digging into his pockets like he was going to get it but he wasn't really so much as getting the money as buying time to wear me down. Once it became apparent he wasn't going to pay me I flat out told the guy no.

Ooooooh boy, that guy started cussing me out and repeatedly made comments about how I was like then private citizen Donald Trump because I wouldn't give him a smoke. I wish I could remember all the stuff he said because he went on for two minutes or so just yelling shiat out about how I was Trump.

It was somewhat surreal but the guy probably would have been handed a free smoke if he hadn't acted like I owed him one. I'll never understand people who don't realize the power of "please" and "thank you," you want somebody to do you a favor and can't even be bothered with the minimum standards of courtesy?

She got out of her car to yell at the guy, then was half of an escalating  screaming match with a homeless guy and when he didn't back down she returned to her car, got her gun and tried to murder him.  Maybe she was afraid of the consequences after she shot him, but at no point before leaving the scene did she act like someone who was at all scared, she acted like an opportunistic predator.

Considering Florida has said its self-defense to drive home, get your gun, drive back, and then shoot the guy who was "threatening" you by being black and playing that hippty-hop music without even knowing you existed, she may have a case.

Don't forget. 
You can walk in on someone robbing your house, the robber can drop what they have and run away.  You can chase them for 3 blocks, corner them, and force a confrontation.  At that point, you fear for your life and have to stand your ground and shoot the bad man.

So no where in the story does it indicate they drew blood.  Which is pants on head ridiculous because if she were any shade darker than they would have gotten a warrant for a blood draw.

But they didn't nor did they provide any other information about searching the vehicle or impounding it as evidence.

Nah, the latter group hasn't given up.  Both believe in the social contract.  The "give up" people realize you can't prop up a social contract on your own with locks and guns.  This explains both the before and after for them: before, they never felt like they had a "safe bubble" because they know the social net is imperfect and that trying to physically secure yourself is mostly futile.  After the robbery, they understand that there's no quick fix, either physically or socially.   Any solution to the problem will have to be social-- even if the social solution is "everyone is now armed, takes watch shifts, and agrees to shoot robbers."

Saying "nothing can change that" was perhaps a bit glib and oversimplified on my part.  What I should have said there was something more like "there's nothing you can do alone to change this."   Arming yourself can't fix a social problem.  That requires a social fix.

But none of this was to argue that one of the options (gun or no gun) was better than the other-- just to try to explain why some people don't experience that brutal "loss of sanctuary" after a robbery.  They didn't think they had sanctuary, and they don't believe it's something you can achieve alone.  So they don't feel the loss, and they don't see buying a gun as a fix-- but that doesn't mean they don't see the problem and want it fixed.  It means they saw the problem before the robbery, too.

Ah, stupid fingers cut me off.  Deadpool.  I resisted vehemently as I don't normally "do" superhero type movies, but it is so NOT a superhero movie, it's a great character study, funny, slightly provactive sometimes.

I'd recommend it highly, one gal to another.

I've known a few lawyers who tend to look down on criminal defense practice as beneath them, they tend to be folks who've had a rather privileged existence and take it for granted that they'll never need to remember even the basics of criminal defense.  They just refer such grubby matters to a junior associate or someone outside their firm, and get on with their lives of dumping work on junior partners, scheduling their next trip to the country club, charity gala and assorted schmoozing activities that their timesheet will categorize as client development.  If they are absolutely forced to deal with criminal defense, they're too  arrogant to actually get themselves up to speed on what they've forgotten and bluff their way through with a "do you know who I am" or "I'm a very good friend of (insert name of judge, sheriff/chief of police, state or local politician they've given campaign contributions to or played golf with)"

I think daddy's little girl has got herself into a jam someplace outside his 'pull.'
