Pretty much this. I'd have put it a bit differently -if you are comfortable with the idea of not hitting your target, then you have no business firing- but the principle is the same. That's basic gun safety. Warning shots are reckless brandishing eveb in the best case, and this particular scebario, where it actually did hit someone, is something way worse than that.

Being Flint, it's a coin toss for both parties.  I was able to find Shawne Felton online, he's a black man who went to Mott College.  I'm sure that surprises the Fark brigade that he only got probation.

Not true, has never been true.

It's just that in order to be justified in firing a warning shot, you have to have the same set of circumstances existing that would justify deadly force, AND you have to be able to do it without endangering anybody you wouldn't be justified using deadly force on.  Which means if you decide to take one, you'd better be really good at re-aiming really quickly, and you'd better be outdoors, on soft-ish ground, and fire it in a direction that will only conceivably embed it in the ground.

But yes, there is absolutely such a thing as a legal warning shot.

Eh, sounds like he has a witness that agrees with his story that she was trying to force entry to his house, and she doesn't have a witness.

She says she was trying to collect money, which wouldn't justify her forcing entry, and though that's disputed, he's got one more witness than she does.

He apparently wasn't trying to shoot her, she apparently didn't dispute that, thus the unlawful discharge of a firearm causing injury.

The choking and pointing the gun at her bit was apparently disputed as well, sounds like the prosecutor and judge didn't believe her about that part.

In any case, it was a plea bargain, used the way they're actually supposed to be used, as a way to quickly clear a charge that was initially appropriate, the felony assault, rather than the usual American method of massively overcharging a crime and plea bargaining down to something still overcharged.

No reason to disbar the judge, sounds like this is one of the better ones.

Oh, and not only does this keep somebody out of prison, thus saving taxpayer money, it also means this guy's about to get sued for her medical bills and lost work, thus likely saving taxpayer money.

Not in Flint, cops don't bust for pot unless it's an obvious grow house or dealing.  If a cop sees you smoking, just don't blow it in their face.

Back when I lived in Chicago, I'd see signs that committing a crime with a firearm was a mandatory extra time in jail.

This is assault with a deadly weapon. Lock the arshole up, and take away all his firearms, and his right to ever own one again.
