I think Scalia once argued that if a punishment was simply unusual but not cruel it would be constitutional.

But in the meantime, the patsy's ass is most definitely grass.  He is Owned, in the most literal sense imaginable.

There probably should be. We have laws against gouging the prices of necessary items during disasters. Medication is a necessary item and many illnesses are disasters.
