Stop greenlighting "Omg!!!-hedge"

2017-08-26 08:51:49 PM
Yes, you do. Even if this law was written in such a way that it authorized searches on people's property without a warrant, it will be struck down the first time someone sues. It's a pain-in-the-ass that it often has to come to that, but at least there's a path.

2017-08-26 08:54:58 PM
The patriot act already allows for warrantless searches I believe.

2017-08-26 09:04:55 PM
I couldn't find any info on how the Senate voted on this.

If there isn't one, does that mean it was passed by voice vote?

2017-08-26 09:04:57 PM
Not in Washington State it doesn't.

We outlawed warrantless searches.

2017-08-26 09:24:04 PM
Remember all those paintings of Obama burning the Constitution?

2017-08-26 09:34:02 PM
It appears to be only in the DC metro area.

/ I could be wrong, I only read 3 sentences and a bit of a 4th.

Against my better judgement I read TFA.

Zero Hedge is very confused about how utilities easements work.

This.

FTFA:

"In performing its duties, the Commission, through its Board or designated employees or agents, may:Enter upon the WMATA Rail System and, upon reasonable notice and a finding by the chief executive officer that a need exists, upon any lands, waters, and premises adjacent to the WMATA Rail System, including, without limitation, property owned or occupied by the federal government"

See the "owned by the federal government" part?

2017-08-26 09:39:40 PM
The law says that WMATA can enter federally owned or occupied property that is adjacent to the metro if there is notice given and if an adjudicator finds that there's need to enter the property.

Yawn.

snarky kong: The law says that WMATA can enter federally owned or occupied property that is adjacent to the metro if there is notice given and if an adjudicator finds that there's need to enter the property.

Simulpost?

+1 sir

It's Zero Hedge...So, now I doubt the existence of both Congress and the Constitution.

2017-08-26 09:41:37 PM
Think of all our great liberal leaders in the Congress.
Now imagine that they all voted for a bill in order to deny our constitutional liberties.

see the part that says "any lands, waters, and premises... including" right before that? "Any" premises, "including", but not limited to, that owned by the federal government.

/I thought the same thing at first, then reread it and realized it was only specifying that the federal government isn't exempt, that that it only applies to them

Do we need Zero Hedge articles in order to get people to say, "Yeah, Palmer Report is bad, but it's not Zero Hedge bad."

That's how living next to a rail road works. They may have to go inside your property to fix something...

I'm pretty sure that if this was related to criminal issues, the 4th amendment applies...

You can't just write a law

So, you're saying that is possible that the constitutional convention never happened and that we're still a confederate of separate states?

/ if that's the case, one would almost be obliged to give a "hurrah" for the pre-constitutional convention confederacy......

Yeah, that was my point above. "With reasonable notice"... if "need exists". Basically it sounds like the right a utility has to come on your property to check the meter. If this is used in a way that violates the 4th, it can be fought on that basis. Otherwise, this is a bunch of "meh".

much ado about nothing.

I made this sarcastically in a fit of drunken Poe's Law anger before the 2012 election, and never backed it up on cloud storage. The folder on my PC that contained it was deleted.

With mixed feelings, I find that it has metastasized to teh intarwebs.  Bleh.

I found myself longing for the reasoned discourse found in Yahoo comments.

Didn't they try this in Indiana or someplace and a judge ruled that a homeowner would be justified gunning down any police officer that tried doing a warrant-less search? Pretty sure it's still a bad idea on all accounts.

Be outraged that Zero Hedge is still getting the occasional greens here.

Be bemused at anyone taking it seriously.

Be saddened at the intellectual deterioration of a society that creates a popular Zero Hedge...or Infowars.

See the "owned by the federal government" part?

As I read it, it's not limited to federal property since it says 'any'.  The fed property is 'included'.

A poorly-worded law that could in theory be abused if all of the other laws that override the offending abuse didn't exist is not the same thing as the government actually taking away your rights.
