Boucher asked for permission to search the vehicle and was denied. A K-9 unit arrived and indicated there were narcotics in the vehicle, which led to it being impounded, according to Batelli.

Topping and Green were transported to a hotel while the search warrant was processed but officers found that they never checked in, Batelli stated.


Maybe they found a better hotel/price on Priceyak. Priceyak where the smart people stop before they go.

Yelp Review: Cops dropped us off at this place. No pool. No breakfast. Lobby smelled. Would have given it no stars if possible. Went down the street to a Hilton Garden. Indoor outdoor pool, full breakfast, and they take ecstasy in lieu of cash. 5 stars!

hell as a white dude i have NEVER heard of cops calling a K9, having it alert on the vehicle and the police finding the occupants a place to stay other than a jail cell.

This is what I was thinking as well.
Cop pulls you over, can't even do the "I smell drugs" bit, calls a K-9 unit.
So because the unit is far away, and because this probably wasn't a lawful stop, they can't really detain them. So they tell them nicely to "stay at the hotel, and not run away, you hear?"
Obviously didn't work.

In cases like this, I personally see two possibilities (and IANAL) either the cop has probable cause to search, or not.
Asking for a search warrant doesn't make sense.
Detaining them until they get a dog over to bark on cue makes no sense, but no body is fighting that AFAIK.
I suggested before, false positives of dogs barking and nothing found in the car should be documented to statistically prove if this, uhm, sniff-test works, or more likely doesn't.

/And I say that as a guy who had a kid who'd yell at the dog "OH LOOK CAT! CAT!" And the dog will just start barking and jumping from side to side.

And FTR, the cop probably figured out the couple were up to something by the panic in their eyes/sweating profusely/arguing when the cop steps away/etc.

And also FTR, all of those are probably not admissible in a court of law as reason to search.

They do not need any reason to call the dogs. The dog established probable cause for a search. Matters not what they were saying and or doing when the dog alerts. The only weird thing is letting them go while this was taking place.

If the police were concerned about legal search they didn't have to worry after the dog.
