is $25-30 theft really a felony charge?

it isn't even grand theft.

this bothered me in the article and sounds like they are really being charged with not respecting my authoritah

"The release says Cotton filmed Messer taking the cake valued at $25 to $30. Sheriff's spokesman Deputy Gilbert Acciardo says employees confronted the pair, but Messer used profane language to tell them it was now his cake."

I am guessing assault and intimidation, maybe even hate-crime depending on the words used....

"It's my cake now biatch" is a pretty solid way to convince them to press charges over a $25 prank they would normally just call your mommy over.  You had to shiat in everyone's cornflakes Mr Cool Ice, I'm sure you can plea bargain it out to just probation.

Criminal acts, such as theft, vandalism, and assault, are not pranks.  No, not even if you film it and upload it to YouTube.

(Nor is asking your babby momma to shoot you in the chest with a Deagle.)

Pranks require, at a minimum, familiarity with the target, and a sense of fun.

When dude at work takes vacation and you fill his office with balloons, that's a prank.  When you steal a product from a store, that's just theft.

Russ1642: Some people think that if they call something a prank then it's no longer a crime.

This. Now, I'm not sure it ought to be a felony, but something tells me there's information left out. Threats of violence or harm may rise to the level of a felony charge during a theft.

They'll probably end up pleading down to some kind of misdemeanor and doing community service. Maybe even with it staying off their records if they behave themselves. But it isn't going to be laughed off, nor should it be.

From another article

Acciardo said the cake was valued at $25 to $30. That could have resulted in a misdemeanor theft charge.
However, officers chose to charge the two with felony third-degree burglary because of the circumstances, including that the two went into a business and left despite being confronted by employees, Acciardo said.

The charge could be reduced during the court process.
