What they did was reprehensible, but unfortunately, not illegal under current Florida law. But this is the sort of incident that drives change, so the next group of immoral reprobates that do something similar will get what is coming to them.

Good Samaritan laws should be passed on a Federal level, so that this sort of thing isn't allowed to go unpunished anywhere in the US. For Gawds sake, just call 911!

The best thing to do is humanely euthanize these teens and slice their brains into paper thin sheets. Figure out how a human being can exhibit this kind of behavior and try to prevent it from occurring again. Oops, I said human being, misspoke.

I'm not so sure. All it would take is for one of them to start laughing and pointing and the others would go along. Once it got going it might not stop. Teenage boys are mindless herd animals around their peers.

Nothing more to be said. If you "free speech" advocates are cheering this, or whatever you call that peculiar form of freedom you think you enjoy (probably the kind where you have to carry a gun all the time, right?), nobody goes free here. Those kids will be just as cruel and callous to everyone they meet forever, and nobody will ever win.

Not a lawyer yet, but I think depraved indifference only applies in a context where a crime has been committed. Maybe if someone had pushed the guy into the pond it would work.

It's one thing to not help if you feel doing so also puts you at great risk, it's another thing to not help when doing so puts you at no risk and in fact you withhold help and take pleasure in the death of someone.

I recall the guy in Britain got charged when his girlfriend "fell" off the pier and drowned as he watched and did nothing.

So yeah I see a law getting passed here in the US and I'm ok with it

The first day I woke up in my new apartment after moving to Tampa on a whim 20 years ago, I was surprised to find my place surrounded by yellow tape and a dead guy floating in the lake behind the balcony. But after spending so many many years in south St Pete, I don't think I'd have noticed it much. Hey at least they were engaged in the community!

I wouldn't mind having a go arguing that their taunting added to his mental anguish during dying, thus occasioning assault, or at least making them accessories to death by misadventure.

It may not fly criminally, but the deceased's heirs may find a sympathetic jury to hear this argument in a civil case.

A federal Goid Samaritan law would only apply to federal laws.

Not applicable here.   There was nobody murdering or harming the drowning man.  If there were someone holding the man's head underwater and the kids failed to act, it might apply.   The deceased is a guy who put himself in harm's way.
