Nice pretzel logic - You've smoked too much pot if you have too much pot.  Clearly, he has not smoked enough pot. He needed to smoke the entire garbage bag full of weed before going to a hospital. Then he could safely say, "I've smoked too much pot, because I had a freaking garbage bag full of pot, and it's all gone. Also, my legs have fallen off, but the marijuana did not make them grow back. Please help me."

If both my wife and I each buy an ounce (being two residents in separate transactions) and we put them together in a backpack or purse, I doubt we'd be arrested for carrying two ounces. Now if the bags from the store are opened and in a moving vehicle, that's an entirely different story. They could probably charge the guy for having a big amount with intent to sell, but if it's shiatty homegrown he could argue that it was for (a) personal use or (b) to be gifted out, since you can't legally sell homegrown.

What do you do if you have the legal limit of plants and produce too much? Let's say you have a few very successful plants and want to share your bounty with your hot yoga drum circle love polygon. Sure, it's 1.8lbs, but each individual is getting under an ounce. If you carry a couple dozen bags, you'll be busted for selling without a license. If you have one big bag and start having weird pains from your chakra detox apple juice vinegar colonic and head to the ER, you'll be arrested like this guy.

A small amount of weed if found gets dumped on the ground and again a warning is issued.

That's arguable, but I'd be pretty shocked if any retailer sold stuff that looked like that. There are giant stems in the first picture the PD posted. And what happened to innocent until proven guilty? Wouldn't be on the prosecutors to prove it was retail, not stoner's responsibility to prove it's homegrown?

CSB: I knew someone in high school who rolled his car and went to the ER. While sitting there after being checked, a cop walked into the room holding a backpack and asked if he was so-and-so. So-and-so nearly shiat himself and said yes. The cop said gave him the backpack with his ID, clothes, etc. and said "take care". They missed the four ounces of bud he'd put in the secret pocket he'd sewn in.

I don't think it actually matters if he can prove he grew it or not.  The personal possession limit seems to be 1 oz.  Unless someone can find a link saying otherwise.

Your buddy is part of the reason cops get a bad reputation.  Those actions are unethical, and likely, illegal.  And you say "but its just a Mayberry-type of town".  This isnt 1960, so stop comparing reality to what was make-believe half a century ago.

If your buddy was making the underage people pour their alcohol out, I doubt anyone here would have said anything about it.

As it stands, it sounds like he's essentially stealing from them and taking it for himself (and his buddies).
