I wish the rulings at every turn would be in as few words as possible.  Just to make it that much harder, like when you're dealing with a toddler or a teenager.  The longer you try to explain your response to either, the more they think they're winning the argument.  So, for the judiciary to issue statements like, "Denied," "Ruling upheld on appeal," or "Unconstitutional, case closed," would make the WH response epic.  No parsing, no wiggle room, just full stop, no, you cannot ban everyone for whatever flimsy reason you think of.  Work on fixing the screwed up system in place, stop with the showboating.

Courts to Donnie: "Sorry, a Muslim ban is unconstitutional."
Donnie to the courts: "It's not a Muslim ban. It's a travel ban. SEE YOU IN COURT!"
Donnie to the Trumpers: "The dishonest, low energy courts are blocking my Muslim ban."
Courts to Donnie: "It's still a Muslim ban and it's still unconstitutional."
Donnie: "Stop calling it a Muslim ban! Those are your words, not mine!"

Be sure to let me know how that works out for you all.

"Trump Slump" is already a term being used by domestic and foreign travel agencies to describe his impact on tourism dollars flowing into the USA. I hope the coming recession (if we're lucky that's all that will happen) will end up in history books with that name.

The ruling was based on what Trump said during the campaign.

Basically, the judge said "I don't like your tone, Mister"

There is no basis in law for the ruling, and it will be swatted down unanimously at the supreme court.

I like Trumps idea of going forward with the original injunction. Since they're obviously going to say no to anything he submits, he might as well go for the gold.

There's a part of me that is feeling such wonderful schadenfreude for my cousin.  She's a travel agent (who also just happened to vote wholeheartedly for Trump), and now she's been looking at a loss of a ton of business due to the bullshiat this administration has been doing.

I want to tell her "I told you so", but the fact that she's seeing the pinch in her pocketbook is enough for me.

Yep he could also just write a new order banning all refugees, although this would likely violate international treaties and invite other countries to do the same.  But given that Trump stated publically that he is anti-Muslim it's going to be hard for his attorneys to say otherwise in court.  Just wait until his health care bill and budget is approved and all heck breaks loose.

And we also have hate hobgoblin Rudy G running his fool mouth about making a Muslim ban that doesn't look like a Muslim ban in court.

Donnie-dimwit's ego is heavily involved here.  I expect him to say plenty more that his prejudicial to his case.  Especially if he keeps holding those stupid rallies-which cause him to lose what minuscule amount of discretion he has and say so many unwise things under the influence of applause, like how he preferred the first (and even more unconstitutional) ban.

Consider this: in a legal case, Trump believes that direct petitioning of the judge will help him get his way.  Now, I may be reading too far into this, but it seems that the rule of law and the working of regulations is nowhere in his thinking.  He just thinks that this is an obstacle course to getting his way, and when in doubt just ask, bribe, or cajole until you get your way.

So ... law and order president, eh?

Yeah, that's Dershowitz's opinion, for what it's worth. He also thinks torture is constitutional and that OJ Simpson was framed. His opinion here is a circular argument that since the lower courts used Trump's campaign words in making their ruling, the Supreme Court won't allow their ruling to stand. Which isn't how that works.

There may be good arguments why the stay will be overturned, but this ain't it.

2017-03-19 10:07:08 AM
At first glance the DOJ request seems kind of reasonable. The problem comes in though that Donnie is on record as saying if there are refugees he would prioritize oppressed Christians. So the muslim connection is inherent in this part too.

Those parts of the executive order apply to refugees from all countries, not just the six Muslim nations and thus should not be part of Watson's injunction if the ruling is based on halting Muslim bias.

Regardless of what you think of the EO, from a constitutional perspective, they have a good point.

So we are a country being run by the Judiciary, the Intelligence community and the protesting crowds. Well, that's one way to do it, not very efficient, but one way.

Sorry, the courts tend to take the establishment clause pretty seriously.

Sorry, Allan Dershowitz is not a judge.  Nice cherry picking though.

Sorry, intent does come into play when you've spent the better part of a year saying you're going to ban Muslims and then try ban Muslims, while not saying those particular words (and the WH's own studies show that the ban won't do shiat to combat terrorism).

Trump has had great success pushing people around by
- saying what he wants because he's rich
- saying what he wants because he's the boss
- saying what he wants because he's famous
- saying what he wants because he has no shame and will pile lies on top of lies until you just give up

The legal system however is highly structure and if you try to pile bullshiat on a judge their answer is "proof or STFU".  His go-to threat is "I will sue you".  He nearly always however
- never does
- settles because his as stated above, judges see the same BS from poorer people all the time and will not put up with it
- loses

At the end of the day most people who are drawn to any sort of military or law enforcement career are authoritarians at their core. I'm not the least bit surprised that a non-trivial portion of the DoJ is bootlicking for a wannabe dictator.
