Sounds like such a decent guy... FYI, having worked in fast food, giving refunds absolutely sucks (difficulty wise), the smart thing would of been to apologize, correct their order, and smooth everything over with a large French Fries and/or onion rings.

The DQ owner is an absolutely stupid guy. However, as someone who has done a decade in the restaurant business, I truly doubt it went down that way with the customer being a total angel. In fact, I bet there was some despicable actions from her side as well.

However, once you go full racial and not only start dropping N bombs but continue to do so when the police arrive, you lose. If you want to argue back or be insulting, just keep race out of it if the other person is black or Latino. Basic knowledge.

They seem to be the default 'small town restaurant' here in southern MN. I have to admit, I was shocked as a youngling to travel out of state and discover that in most places, DQ's are open all year long. The ones in our area always close for the winter.

Because 911 calls are recorded, non-emergency lines are not. They want a record of why the cop was dispatched to your location, even if it is to pick up your weekly "donation" to the PBA.

okay you cannot blame a lawyer for trying to get the client (and themselves) paid.
also the lawyer is probably doing this on contingency, on the chance that just filing a few papers will get them a settlement deal w/o having to go to court.

I'm gonna go with the Corporation. Plus the franchisee was clearly in violation of the "moral terpitude" clause that I'm sure is in his contract.

In fact, most employment contracts have a clause that if you make the company look bad or you do something egregious like this...BYE BYE!


Also, beyond the moral and PR case, he exposed DQ to very real liability under the Civil Rights Act. If you operate a business, you have to serve black people on an equal basis with white ones. If you don't, the people you refuse to serve have the right to file a civil action. Now, actual damages in this case wouldn't be much, but I'm sure a jury would be quite delighted to hit this scumbag with a gigantic punitive award, and if the plaintiffs file suit against both the owner and DQ itself, DQ would wind up on the hook for a good chunk of that money. DQ would lose a suit, DQ knows they would lose a suit, so they're cutting this guy loose and almost certainly are already making overtures for a preemptive settlement.
