d23 - agreed. Kozlowski *should* fry. There's mountains of evidence, the prosecution did a damn fine job putting on thier case and the defense team was so afraid of Kozlowski's asinine personality that they didn't put him on the stand. But it might all fall apart because one juror decided to be a complete and total jerk.

We might have to face the very real possiblity that Kozlowski might just manage to beat the rap and walk away from his crimes scot free.

Two things:

1)It wouldn't surprise me if she was paid off.

2)Even if it does mistrial, I can't see why they wouldn't retry him. It seems that the prosecution has an essentially airtight case. This is just one juror who, for whatever reason, is ignoring the evidence.

so im out with the people at the law firm I work at last night (not a lawyer myself, just a lowely worker monkey) and the boyfriend of one of the attorneys is there, giving me advice on the ins and outs of being a prosocuter in Boston

"at first you're going to be in complete awe when you approach the judges, but after the first few months you learn that most of them have stories... you learn that this one gets his dick sucked by a prostitute monthly, this one was a trial lawyer who couldnt win cases but knew someone on the inside, ect... "

Most of what I've heard of judges is that they are all lawyers that couldn't hack it. If they could hack they would still be lawyers.

Those that can not do, teach.

Those that cannot try, judge.

Double jeopardy would apply if the prosecutor lost the case, then attempted to retry the defendant on the same charges.

A mistrial is neither a win nor a loss, it's just a do-over. In legal terms, meaning the first trial didn't even happen.

So no, double jeopardy wouldn't apply.

I was thinking Jury Tampering as well, but apparently this lady is pushing 80 and her attempts to scuttle the case have been far too overt.

I'm now thinking it's likely she is simply mentally deficient. I guess she was sharp at one time, but due to old age or whatever she has quite clearly "lost it". Why else would she give the "Ok sign" to the defense?

Since she is a lawyer, she would well know that such conduct is unseemly at best and illegal at worst. And her obstinance in not even being willing to discuss the case with her fellow jurors strengthens my feeling. Only a lawyer that had lost her mental faculties would behave in such a way.

They should really test jurors for mental deficiency before allowing them serve.

I was on a jury once...had to to with 'messy' financial records and stuff. A lot of finance was discussed during the trial, at which time the juror seated next to me would take the time to doze off. Guess who was the one juror that made us a hung jury?

(nope...not me.)

I remember once I was sitting a midterm and just before it me and my friend were doing the old "ok so 1 knock is for a and 2 knocks is for b" thing. THe thing is when the test started in the first minute when everyone went real quiet he asked really outloud "What's the answer to question 1?". I have a feeling he would probably do the same thing in a jury.
