Pot metabolites (which these tests detect) persist in the body for up to a month or more. These compounds are NOT psychotropic and do not cause impairment.

Trying to equate and alcohol test (that does detect impairment) with a drug screen for pot (which does not) is illogical and serves solely as propaganda for prohibitionists.

I really wish we could create a useful test for current stonedness not just "have you smoked this month"?  Weed may or may not have impaired him enough to cause the wreck, no real way except his testimony to say for sure.

Wait, is there a blood test that can be done?  I have no idea.  I don't think so.

I say this as someone who hasn't smoked in 15 years or so.  Pot renders someone unable to get off the couch(too much effort) at a point far before they've had enough to negatively affect their driving.  Therefore a person who is too baked to drive safely will rarely ever actually make it to a steering wheel.  So is hardly a much of a concern, unless they wait until they are in the car to smoke their high quality blunts.

I would have no objection to legalizing pot but making it illegal to smoke in the car same as one cannot consume alcohol within a car.

Seriously though he could have just been sleep deprived.  Driving while sleep deprived is every bit as dangerous as driving while extremely drunk.  If you could actually establish standards and test for that, it should be illegal.

What many don't realize is that smoking a little pot probably makes you a safer driver... than a sober driver.  Pot smokers driver slower than sober people (by contrast drunk people drive FASTER than sober people), are less aggressive, and are more attentive drivers (call it heightened "paranoia," awareness, whatever).

In case that argument does not persuade, how about statistics?  Traffic related fatalities dropped by up to nine percent in states that have legalized medical marijuana.  All the fears that the prohibitionists are stirring up about "drugged driving" in states with legal pot have turned up to be little more than reefer madness.

Not news.  The majority of tested arrestees test positive for pot. And testing positive does not necessary mean impairment.

I find it very suspicious when half the country has legalized weed and the other half just happens to suddenly be afflicted by numerous, "pot induced" fatal accidents.  Especially considering that these kinds of things have been unheard of for the last 50+ years, until now... when the hold-out states are trying desperately to drum up any evidence they can to keep pot illegal there.
