Stout also told Fox4KC that she received a letter from the homeowners' association saying that she hadn't gotten the playset color pre-approved.

Yeah, that HOA can go fark themselves.  This is why I hate HOAs.  Why don't these farking HOAs just BUY all the houses and rent them?  Because that's effectively what they should be doing if they expect to have that level of control over residents.

Wait, so HOAs can tell you what do in your back yard, with a swing set, dog house or shed?  I did not know this, never lived in an HOA area.  That is stupid, they should just make sure houses and yards look good and no broken down cars in the driveway, otherwise STFU!

Had a neighbor we called the crazy purple lady.  Purple Cadillac, purple flowers in her yard, she always wore purple, even had purple tinted lenses in her glasses.  She tried to paint her house bright ugly purple, but the HOA wouldn't let her.  She did paint her front door purple, which may have been a compromise.

Other than that all that HOA did was throw a BBQ once a year, and make sure the streets and sewers worked, and mowed my yard.  Not too bad.

In the final stages of buying a house currently. No HOA. Was one of my major points in our decision. Sure, we couldn't move into a brand new subdivision, those are all HOA traps. Instead we found an older part of town that's actually more convenient for us all around, costs less money in a nice neighborhood instead of Monopoly style cookie cutter crap.

While I'd be an idiot to say that this is possible for everyone you would be an equal idiot to suggest that it's impossible. If you purchased a home and didn't make having a HOA or not a major part of your decision, sorry, but that's what  you get.

Yes, they sure can. My uncle's community (it's not called Douchebag Landing but it should be) has an HOA. He had to get permission to plant a shrub in his back yard.

I can tell that you know pretty much nothing about how contracts work.  But it is OK, throw your little temper tantrum if it makes you feel better.

I work for an HOA management company. The HOA must've had some weaksauce restrictive covenants if the judge ruled against them. Here in Texas, land of no zoning, restrictive covenants are airtight and legally sound. We get "Sovereign Citizen" types all the time trying to explain why Jeebus wants them to have purple playground equipment. They always lose, we always collect, I get my bonus. Win-win-win.

Maybe.  Maybe not.  It depends on how strict or casual the rules are.  Some HOA's have rules for everything, including approved colors, number and type of permitted lawn decorations, whether or not certain vehicles can be parked in the driveway, etc.  Some HOAs just collect money to cover the cost of community upkeep.

In some places they do; look up detached condos. Living in a single-family house that you only own part of and have zero rights but full responsibility over everything exterior? Sounds like paradise, sign me up!

Something we agree unequivocally on, nice.

When we were looking every time I walked a property I found myself saying things like, "Plant some bushes for privacy there, the spa  will be over here, that color has to go.." etc... I realized very quickly that a HOA would not be in my future, period.

In that case, the HOA couldn't, but they could get a court order to force him to comply. His jail time was for contempt of court following that.

I really expected the swingset to be a bright plastic purple monstrosity. It's actually quite tasteful and very nice. But what do I know?

A neighbor was able to get a historical commission to specify that their house be painted the original 14 different shades of purple it had originally been adorned in.  HOA couldn't do much under their own rules but watch.  Afterwards, people looked at it and said, "That works."

Once you realize HOA's are populated with people who not only couldn't hack it in national, state and city politics but also couldn't get onto things like school boards you realize that there is NO hope for their leadership. People like Sarah Palin would look great in comparison. Think about that and weep.

I'm kind of shocked that their contracts even let them get it in front of a judge. I'd have thought those would be full of "legally-binding arbitration with an arbiter of our choosing but paid for by the owner" bullshiat.

Pretty much time to storm the figurative Bastille, at that point.  Every HOA member who voted to prosecute gets their houses burned, and there wont be any witnesses and the perpetrators will have rock solid alibis from everyone else in the neighborhood.

Not that I want to give anyone ideas.

Looks like they did that. Even the arbiter was "Uhm, looks ok to me." So the HOA went to court. Twice and lost both times.

Lived in a condo previously. Long story, not by choice, I was a hostage, I swear. In that particular case the HOA consisted entirely of retired seniors. You were of course free to voice any concerns at any of the meetings. Most took place on Tuesday @ 1:30pm if I recall. They literally had absolutely nothing better to do with their lives than to make everyone elses absolutely miserable.

I will admit that, especially in our area (southern ca), supplies are limited and you can be at the mercy of circumstance BUT the choice is still yours.

Sure they can. They're obnoxious enough until you lose it an ounce someone in the face. Then they call the cops and have your ass hauled to jail for assault. See? Very simple.

Its the new back-door debtors prison.  Collection companies are doing this too.  Basically, the sue you.  Every time you show up they ask for a continuance.  If the judge won't give one, they withdraw the case and immediately refile.

As soon as you tire of having to pay your attorney $500 just to appear and don't shot UK, they get a default judgement and you get a warrant.

My daughters are 9 and 11 and they want a little farm garden (corn, zucchini, cucumbers, strawberries, green beans, etc.)  I said sure, never ever thought twice that in some places you could not do that.  When I am in my back yard I could grab a rock and throw it really, really hard and hit the house where President Nixon was born.  I am right next to The Nixon Library and Birthplace and they don't tell me what to do in my back yard!
Side note, my grandfather (Robert), grew up with Richard Nixon, he used to eat at Nixon Burgers and went to Whittier College with him, plus stayed in touch with him for many years.  Kind of cool.
I have a bunch of letters and telegrams between them, here are a few I shot with my phone real fast.
