Is erratic driving enough cause to warrant a car search? I haven't finished my GED in law, so I don't know. I would guess, that if you leave you infant behind, that's enough cause.

Basically, if a cop walks up to a car and sees a bag of pot openly visible from the outside, it's not a search (IANAL). Then the search found the duffel bag of much more pot.

Yes. I am aware. We call it "wingspan". Basically anything within arms reach in the car. No trunks, consoles, etc.

They are performing an open view search when they look. The courts have judged this an exception to the 4th amendment warrant requirement.

Then they must consider whether a seizure is appropriate. In this case the readily mobile conveyance exception kicks in so they require no warrant to seize the evidence of criminal activity.

Searches and seizures are always two separate steps requiring two seperate justifications.

If one must keep illegal shiat in the car, use the trunk ffs.

or, keep the car in such a state of disarray that the average eye cannot discern what they are even looking at.


/this is a far riskier strategy, but yields a story that will get people to buy you drinks, provided you don't get locked up.

Seems to me that leaving his infant daughter with the police is the best thing he did during those events. It's a lot better than running or driving while stone and bringing the little girl along.
I hope the child endangerment charge is because of the DUI and not for leaving her in the care of the police. (Although that would be ironic, 'Prosecutor: Your honor, that monster left his defenseless infant daughter in the care of a police officer,,,'.
