But, according to the family's attorney, a bank surveillance video doesn't show anything like that. The attorney, John Cooper, fought Norfolk police in court to get the surveillance tape. The police have steadfastly refused to release it.

If you are breaking the law and it seems the cops are about to arrest you or confront you over it give up...dont play coy, follow their instructions and do not run, running implies guilt.

And do not back up the car, even if you are backing up slowly, in the officers direction. They will perceive that as a threat and shoot you.

Play stupid games, win stupid prizes.

Dude should have gotten a job and earned his own checks instead of stealing someone elses.

That's the part that gets me.  According to TFA, the report filed by the officers seems to be the most accurate bit of info they have.  It's when the report got floated up the chain of command that it was altered, and then altered again before it was released to the press.  I don't think that the responding officers had anything to do with that, but it really makes the whole department look dishonest.

I know, shocking... especially since these are the same folks with the "if you have nothing to hide..." speech in their back pocket should you not want to give up your rights.

CSB: got to be a witness in a police brutality case a few years back.  After one of the officers used the "if you have nothing to hide..." card while on the stand, the plaintiff's lawyer turned it back on his department by requesting the video footage which was mysteriously absent.  The sheriff's dept. was not amused that the judge agreed with the lawyer that they had to turn over the footage (long story short: they were guilty as hell and tried to hide it; thankfully they were also very stupid about digital media).

One suspects that if the video corroborated the official line it would have been leaked long ago. I wish the story contained the official explanation as to why it's being withheld. I always find it interesting what officialdom manages to invent when trying to excuse something indefensible.

I prefer to live in a world where the police are ALSO held accountable to the law, like the one that says this is almost certainly murder.  The police have no more right to shoot that the average citizen.  If the attorney is telling the truth, and I think we can all agree there's a strong 80% chance he is, than that officer should go to jail.

Also, shooter should also get nailed for not having a clear line of site when he fired.  We have proof of that, what with the bullet in his partner's leg and all (that they tried to lie about for some weird reason... oh, I get it.  If he was able to shoot his partner in the leg, his partner probably not behind the car... or is it, he shot his partner and that's why he was in danger from a car traveling 5 mph?)

Cops shoot people without hesitation because there is no accountability. In fact, most get paid vacations and donations from the NRA, KKK, Newscorp, or some other other pro-fascist group, sometimes all of them depending on the situation.

If you jump in front of or behind a car it's not attempted murder/etc it's attempted suicide.  I don't care what the suspect is wanted for.

Seems like there are a lot of people around who are guilty of assault on a police officer's recollection. There is no evidence against any future claim showing that the attempted check casher--after trying to reverse his way to bad check boy notoriety-- DIDN'T grab an officer's gun after he had been shot and killed. The officers, who in no way could convince the ignorant public that a dead man did the shooting, had no choice but to cover the story. They would be sent for psychological eval, and possibly, would not be paid during that time.

been a pet idea of mine since my Crim Law Clinic days to create a searchable database of all police reports cross indexed by officer, and possibly transcripts of their in-court testimony as well, so you could enter key phrases and see how often the officers gave the EXACT same story on the stand.......since I don;t have a few spare millions just right now, however, it remains a pipe dream

Given that it's the bank's surveillance footage, I suspect they'd keep a copy - legally or illegally - just in case the family filed a suit against them (sue everyone and hope it sticks to someone, no matter how tangentially related).

I can see the bank more than willing to throw the cops under the bus to protect their bottom line.
