this one time?
At band camp?

I guess they can only play public domain music now, like "Mary Had a Little Lamb", which could be a bestiality song.

So they could get "Rump Shakers?"

I guess they'll have to play I Can't Get No Satisfaction instead.

Ask Jane's Addiction, Rage Against the Machine, or the estate of Zappa if they'll let them play their music.  Pretty sure they'll all say "yes."

Also, because I've never listened to their halftime shows, I have to ask...is it just me or shouldn't they be looking to play music younger than the 2 years they say this show was under preparation? Or is it that they were trying to get "Anchors Away" or some Glenn Miller stuff?

Why do they need a license to be a cover band? There are literally thousands of them playing in clubs across the country every weekend.

2014-08-29 10:37:35 AM
You mean they don't play "Louie Louie" any more?

Their performances are broadcast, or at least portions are, so that may be the reason. ASCAP does not fark around. When I was in high school marching band, ASCAP "audited" our sheet music to make sure everything was in order and we weren't using photocopies of anything.

According to Wikipedia, compulsory licensing applies to selling copies of music (e.g. vinyl records) but not public performances.

Okay, well, they definitely need the sheet music to learn the songs.

I HATE Ohio State but I'm put in a position of defending the band and the university.  This criticism they've received for being college kids and coming up with stupid nicknames for each other and OMG a lapdance has really gotten out of hand.  The stuff that they did was so utterly stupid and relatively benign.  Lighten up people.

For the publishers, it is Legal CYA. It is not out of realm of possiblity they could get named in a EEO or Title 9 suit as a potentially responsible party for granting the license.  Lawyers look for deep pockets and easy settlements and they would be getting both.

Thats stupid..... In most cases, that band would be doing the artist a favor by playing the song.

Its hard to believe that the owners of Hang On Sloopy and Wooly Bully feel they need to protect the sanctity of their property.

Of course it's sexualized.  It may be the last time some of the bearded, fat drummers and tuba players get anywhere near a woman for the next 30 years.

Yeah!  Why should anyone who desires to spend 4 years of their life participating in a highly rewarding musical and social experience that can lead to future professional opportunities be exempt from sexual objectification and harassment?  Come on people!

or did you mean The Ohio State University ®? because I'm familiar with that one.

Which is more sexualized: College, band kids, or the Music Industry starring Miley Cyrus and Katy Perry?

Janes Addiction's songs are controlled by a number of publishers including Sony and Irving Music.

Zappa's material is controlled by a big indy publisher in NYC, represented by a fairly-well-known attorney.

RATM's songs are (depending on writers) published by Universal or Wixen Music or both.  A few with additional writers have the full laundry list of Warner Publishing, Universal, and EMI.

Pretty sure you're wrong.

I just hope they get the license for "Imperial March" from Empire Strikes Back.  I hate to think what a college football game would be without that.

If you had access to local papers, you would see that there's a lot more to it than that. Institutionalized hazing is not hyperbole in this case, and it's been going on for decades. The recent kerfuffle of firing the band director John Waters was not because he tried and failed to put an end to it, it was because he was part of the problem. Considering he had been an integral part of the band for almost twenty years, you don't let the problem maker fix the problem.

Now that they have president that can think about more than football, hopefully there is going to be some power balancing and course corrections that are long overdue.

I'd laugh if it was the publishers of Rihanna or Robin Thicke complaining about the sexualized culture.

I guess it is a good thing that UVA's old band got shiatcanned. The publishers wouldn't like their schtick, either.

But Florida A&M's marching band can haze somebody until it results in their death and that's just farking fine and dandy.

That's the issue right there.  Kids do stupid shiat like that all the time.  But the "adult" in the situation not only allowed it to go on, he participated.

Yeah, I was trying to think of what popular music wasn't already there and I was drawing a blank. And since when did music publishers get so squeamish anyway when royalties were in play? This doesn't sound anything like a deal where some musician doesn't want a politician to use their song, so it's all very puzzling.

Or stupid. Maybe just stupid.

On the other hand, the band members seem genuinely and inexplicably surprised that an adult institution expects it's members to behave like adults.
