Good for the City Attorney here.  While I agree with the regulations banning public smoking for now (it's important that the pro-legalization crowd does everything they can not to be a nuisance until the tipping point is reached and it's legal more places than not so it's less likely to be turned back) I do think that over time there should be protections for people who want to use marijuana in public as long as it's done far enough away form others who may be annoyed by it.

FTA: City Attorney Pete Holmes says the tickets written by Officer Randy Jokela were issued mostly to homeless people, and often featured handwritten notations by Officer Jokela mocking Holmes and the legal-pot law.


Using tickets to make political statements fresh on the heels of the entire department being investigated by the DoJ for its use of violence against the citizenry. Lovely.

I would side with the cop writing the tickets except for the whole coin flip ticket.

That's just bullshiat.

Don't smoke pot in public if it's illegal.

Okay, go ahead and light up if you want.  I've done it before, but try to be discrete and don't whine if you get busted.

Easy for me to say since I've never been busted.

It's not about smoking weed in public. It's about browbeating people (mostly homeless people) as a petty political statement, and about throwing your weight around as a law enforcement officer. I don't care if they're smoking crack in public -- that shiat doesn't fly.

Maybe you missed the part that he was primarily issuing the tickets to homeless people. The sidewalk is their living room. The officer is just being a complete ass. Did you read the article?

yes that is exactly what I was going for with my post. seriously i just don't get the attitude to fight a citation that one receives for knowingly breaking the law.
this isn't a civil rights, religious  freedom or free speech issue. In truth this is the sort of behavior that will hamper the fight to legalize it. you start allowing the citations to be meaningless and pot to be smoked out in public the states that are close to legalizing it will pull back and the more conservative states will table any talk.
but please go ahead and fight the citations


The City Attorney says fight the citations. Not every citation for public smoking, just the citations issued by this particular cop. Why? Because he was using it as a means of harassing the homeless and making a political statement. He is getting investigated by his own force. They don't waste their time on that unless he is out of line.
