On Sunday, Sept. 29, 2013, after receiving a complaint from a downstairs neighbor, Sgt. Tod Himmer was dropped off in plain clothes at the condo complex. After spending some time in the downstairs apartment, Himmer said he "could hear Ms. Abernathy stomping her feet, nonstop from 11:06 p.m. to 11:10 p.m. At 11:10 p.m., Sgt. Himmer heard an extremely loud bang that shook the ceiling of the unit," according to court records. Several minutes later, Himmer said Abernathy started to "open and slam close" her porch door. "Repeated stomping kept coming from the kitchen area along with the cabinet doors slamming closed," Himmer said. Abernathy was subsequently arrested that night.

According to this article, it wasn't just the downstairs neighbors who moved; also the next-door neighbors filed complaints as well, and this went on for over a YEAR. And all this started right after she moved in; those positing that it was the crying baby who drove her over the edge are wrong--she hadn't been in the apartment long enough for it to be an issue.

This woman is just nuts; the judge really should have put her in a psych ward for six months.

I have no idea why my upstairs neighbors sound like they are having aroyal rumble every day, but I'm glad I found a house.

Jesus.  That woman's got mental health issues.  If they don't get her treatment, she's just going to keep on doing this the rest of her life, making everyone around her miserable.

Replace the desks with apartments and condos and you get an unmistakable cone of miserableness.

This lady sounds crazy.

When questioned by the judge, Stockwell-Alpert said he did not have any documentation that indicated whether Abernathy had psychological or mental health issues.

...if it walks like a duck, quacks like a duck....I mean people with normal mental capabilities wouldn't do this. Well, since governments have been closing down the cracker factories, all we have left are jails.  Not known for dealing well with mental cases.

It could have been something as simple as asking her to be a bit quieter; some people take any perceived criticism poorly.   Then again, they may have been jerks to her as well, and she stepped it up into crazy level.

I'd assume the judge heard both sides of the story.

I have a middle aged couple living directly above me and in 14 years the only thing I've ever heard is when they inadvertently drop something.  OTOH it is an older substantially constructed building.

I was once unfortunate enough to live above a screaming baby. We thought, for a while, as do so many of you here, it was just a spoiled brat with overindulgent parents.

After the CPS visit, we learned it was in fact an abused child, whose parents were alternately beating it and neglecting it. That was when I learned that if a baby cries nonstop around the clock, SOMETHING is wrong. It may be abuse/neglect, it may be the baby is extremely ill and in chronic pain...but babies don't just cry. If you live around a baby that is crying all the time and it annoys you...something's wrong with the baby.

I just forwarded this to my landlords to forward to my upstairs neighbors. They f*cking stomp around at all hours of the day. Not constantly but last time it was 2:30am and they wouldn't stop even after I asked. They are horrible people.

That makes all the difference.  I've lived in new and old places.  Some of the newer ones have paper thin walls and ceilings.  I'm in favor of including sound insulation as part of building codes.

I decided long ago NEVER to live under anyone.  After my experience with where I live now I will never live in multi-unit housing again.  I can hear my neighbor's conversations through the walls.  I can hear the beeps on their microwave and when their microwave is cooking.  It's farking ridiculous.

I hate my neighbors and they hate me, but we don't go to war about it.  We try our best to avoid each other and that includes NOT being noisy.

my very first apartment was a 2nd floor unit with units above and below. im pretty sure both of them hated us. a bunch of 19 year olds who partied until all hours any night of the week. we didnt try to be disrespectful but this was teenaged guys doing teenaged guy things with our "techno" music and video games. the people upstairs used to bang on the floor when they thought we were too loud but, it didnt matter how much quieter we tried to be, they'd end up banging some more. it got to the point where we didnt even bother turning down our stereo (b/c it still wouldve bothered them enough to bang on their floor) and just started banging on our ceiling any time they did the same from above. amazingly, no one ever had the police called on them... at least not in our building
