Doesn't mean a crime WASN'T committed. If there's cops out there actually arresting people for selling cigarettes, it will be a vice cop. Vice cops are the lowest form of judicial life. They're even worse than meter maids. Quite often they're even worse people than those they arrest.

Suspended, no pay, in jail while they suss out ways to prosecute for murder and make it stick is a good way to start the investigation to see if a crime really was committed.

I notice most of the news agencies are concentrating on the "selling cigarettes" thing, as if it were actually happening.

Eyewitnesses (and the woman who shot the video) say Garner had broken up a fight on the street, and wasn't selling cigarettes at the time.  Upon arriving for the fight, the cops recognized him as someone who had a history of selling cigarettes.

If that's the case, they didn't have a reason to hassle him in the first place, as he contends on the video shortly before his death.

100% true.  However, there had been a possibility that the coroner would say he died of an existing medical condition or an accident.  So it isn't as big a deal as it sounds, but it is still a deal.

It may not mean a crime, but considering the fact that the homicide was committed by means that directly violated NYPD policy, his surviving children all get to go to college from the civil suit settlement sure to come.

So, if the snippet is right, it wasn't the "chokehold" that did it. It was them piling on top after they had him on the ground. Garner's weight plus cop's weight=no air displacement in the lungs.

No matter.

I'll still give it less than 50/50 charges get brought.

Well, the video shows that they did nothing. My reaction was actually the opposite--I feel bad for the cop (slightly) because he was just trying to arrest the guy, and he used a hold he shouldn't have, but the EMTs where pathetic in this case, from the video evidence anyway.

But, man, cops need to stop wrestling black men to the ground whenever they get any back talk.

Medical examiner concludes chokehold used by officer was the cause of death + videotape of the chokehold used by the officer = "We'll investigate this and closely monitor it". Guarantee if it was the other way around, especially considering it was a black victim, he'd either be in prison for life within 2 hours, or more likely pumped full of dozens of rounds of ammo by the cops.

Sometimes I don't know which is worse, the gang-bangers or the cops (often one and the same thing).

Not only that, but trumpeting "homicide" generally means it's not murder.  If it were murder they would say so.

Tragic and stupid.  Obey the police and fight with them in court.  You will always lose and apparently sometimes die if you decide that you aren't going to comply with them.  Yes, the cops broke the law and are definitely responsible for this poor man's death.  Hopefully justice will be served and the racism angle won't have it's run through the community.  Sadly, it wouldn't have happened without his arguing with them.  Let them cuff you, take your ride, get your PD, and tell your story.  I do believe they have to prove you guilty of selling loosies or whatever crime it is that they are arresting you for and I guarantee they aren't going to kill you if you obey their orders.  I've been arrested.  I know the drill, guess what?  Not even a scratch, because "yes officer" works every time and "Oh hell no" doesn't work even once.

A guy like Garner is the low-hanging fruit. Of course the Man is going to fark with him.

Bootlegging is quite lucrative in New York thanks to Bloomberg and the health scolds jacking up the tax on cigarettes far past the point of diminishing returns.

Having created a wonderful new opportunity for both nickle-and-dime grifters and organized crime, New York politicians put on their usual grand show of pearl-clutching, pretending to be astounded and outraged that such a thing could happen. They pounded their podiums and vowed to come down on the smugglers in no uncertain terms...and punted.

Way easier for the NYPD to hassle guys like Garner selling loose cigarettes than it is to go after the bootlegging operations.

No, but he could have ruled it was not a homicide.

A coroner can only come to two basic conclusions, assuming the death is not natural causes: Death by "misadventure" (meaning nobody killed him) and death "at the hands of another" (i.e. homicide). The coroner cannot make a determination whether it was murder (intentional homicide) or lawful homicide. That's for someone else to figure out.

Had the coroner said "This was death by misadventure, caused by his being overweight and underlying asthma," then that would be the end of it. Since he said it was homicide, the investigation can proceed.
