This is pretty much the logical conclusion of NYC's experiment with the "Broken Windows" theory on crime. Sure, maybe it brings crime rates lower, but it also results in something of a fascistic police body that enforces even minor laws (jaywalking, selling loose cigarettes (see the case from last week) and illegal grilling) with a highly disproportionate response.

Why do the two males get arrested, but the woman doesn't? Why didn't the female get charged with resisting arrest and/or obstruction?

Barron said one of the cops, a lieutenant, went to the building at 594 Bradford St. Thursday about a domestic incident involving another resident, returned on Saturday and encountered the grilling.

He was probably just so disappointed he didn't get to arrest anybody for the domestic incident he had to find SOMEONE to arrest.

If he arrested her then there would be an arrest record for her. The cop would actually have to disclose the choking incident.

It's all a big game.  By trumping up the charges, the accused has to get a lawyer.  The lawyer then "helps" by getting the bogus charges dropped as a part of a pre-trial diversion program that costs the accused hundreds of dollars.

The city gets paid.  The lawyer gets paid. And they never have to spend any money going to trial.

It's far from a broken window policy thing IMO. NYC has major problems with people grilling on soft tar roofs, old wood structures and poorly ventilated areas. This stuff regularly kills people. Imagine being the ground floor tenants or neighbors of these folks and having your AC unit suck in their grill smoke in 90 degree heat. I don't think anyone should be put in a chokehold, ever, but morons breaking fire codes have no place in a city like New York.

No, the point is that the police responses are disproportionate to the offenses they are trying to stop.

For instance, the appropriate response to an 84 year old man jaywalking is NOT to tackle him with multiple officers.

Yeah...came to say this.  that's not a choke hold...NONE of the photos I've seen of this incident showed a choke hold.  ZERO.

The cop was probably a total dick, but drop the farking "choke hold" angle.  I've BEEN a victim of a police choke hold.  That was not one.

Photos released Monday by an East New York advocacy group show Rosan Miller, 27, struggling with a cop who appears to have his arm around her neck.

Look, I know we decry the loss of objectivity in the media every day. It seems almost every journalism outlet has more or less forgotten how to keep it neutral unless it's on the 'Opinion' page. Yes, people should be called 'alleged' criminals if they haven't been found guilty or plead guilty to a crime, regardless of the evidence that we can all see, it's a part of our justice system, and I think that news media should follow that example.

That said...

I think that you can go ahead and conclusively say that he has his farking arm around her neck, especially when you look at all of the pictures in the series and note things like the blue sleeve, the lighter colored undershirt sticking out of the end of the sleeve, and the black farking gloves...

Choke holds are designed to restrict air or cut off the blood flow to the brain, either way resulting in loss of consciousness.  I got to experience it at the age of 16.  It wasn't fun.  The photos of the incident don't show a choke hold at any point.  The mans arm was across her upper rib cage and MAYBE the collarbone at the highest point.  That's not a choke hold.

An ACTUAL choke hold isn't something this woman would have been able to break free from...she'd have passed out.

You don't do a chokehold to crush the windpipe, the idea is to apply pressure from the sides and pinch the carotid artery and jugular, cutting off oxygen to the brain much quicker than just preventing breathing, so the OP had a point.

Then again, one trying to add pressure to the windpipe to stop airflow would potentially cause more injury than the one demonstrated, so your example works, too...
