Now she's hired a lawyer, who will cost several thousand dollars and take three to six months to evict the tenant, who now has renters' protections under California law because he has occupied the unit over 30 days.

In Long Beach/L.A., the standard retainer for a UD is $150-200. A contested eviction (where the tenant files an answer) will take me about 3 months from start to finish (initial filing to deputy knocking on tenant's door) and cost a total of $460 in court filing fees and process server's costs, plus a bit more if the attorney has to appear in court (another $300-500 depending on the attorney) and possibly a little more for second service, Order to Post, or miscellaneous costs. The only one we've had go over six months is where a very savvy professional tenant filed a removal to federal court which was promptly tossed back to us.

If her lawyer is charging her "several thousand dollars", she needs to find a new attorney immediately.

This is a rental property

In your own primary residence you call the cops and have him removed, then file a restraining order to keep him at bay.  If he breaks the order he goes to jail.

Came to say this. If I owned a short term property, I'd make sure all of my documents specified 28 day terms, just to be safe/make sure they couldn't try to claim they weren't informed until the 30th day.

The only reason AirBNB is affordable is because it encourages users to skirt local tourism and hospitality laws and illegally sublet rental properties. I feel the same way about this lady being ripped off as I would about someone whose black market, unregulated beef was stolen out of the back of a truck.
