Technically this is exactly how nations are formed and expanded. Beyond the emergence of humans as a species, all land has been "owned" by one person or group, taken by another and held by them until someone else comes along. But therein lies the rub. He has to be able to hold it. It's his for the taking if he can keep it. And course, he can't.
