My feeling (and it agrees with the law hereabouts) is if you hit someone in the rear you are an ass for being either so close or so inattentive. No excuses. I don't git a goddamn HOW you qualify or couch it. Stay far enough back and you don't have these problems.

What she did was remarkably stupid and illegal. But blaming her for everyone else's stupid driving as well is not a good precedent to set.

You can't even stop on the shoulder without good reason. Stopping in the left lane, 300 feet into a blind curve is at least contributory, and at worst causative. The amount of time it takes to come up on a stopped object from a distance is so short at those speeds. First, her vehicle was dark blue. Second, she failed to put her flashers on, so the car showed no indication of being stationary. Third, you have to process what you are seeing, because it is so unusual. Time's up.

That said, jail time in this case is uselessly punitive. No justice will be done by putting her in another cage. She is already in one.

Apparently she was parked just over a hill, so they crested the hill and bam, car parked in the lane and death.

I wonder if she could have filed a complaint against the driving instructor because hitting the dog would also be illegal.

I LoL'd at the end result.

The two ducklings were taken to a wildlife rescue in Maine, where officials said one of them has died.

Does that make me a bad person?

The real problem here is the rash of people who are more worried about saving animals than they are about endangering human life. I'm sorry, but I place more value on a human life than a duck.
