A good lawyer can probably get him off with a 'Bad depth perception' defense.

"Kroger is taking this matter extremely seriously and has begun an internal investigation in cooperation with the Suwanee police department," Jenkins said. "Mr. Colgrove is on administrative leave pending the outcome of the investigation."

Wait, so pharmacists at Kroger taking perv pics of strangers now get the same treatment as cops caught beating strangers? I can't wait to hear how his report's going to reword this for Kroger Internal Affairs - "her beaver came right at me!"

Charged him with "eavesdropping"? Looks like Georgia doesn't have a law against taking upskirt photos yet, hopefully they take the opportunity to make one.

I thought they were ruled legal since you are in public you have no expectation of privacy.

OK. I lost all composure right there.

I think they are trying to say that Kroger's is a private place.  As in it's privately owned by Kroger.  A bit of a stretch and he'll probably get off.

Wow. Now THAT is how you throw away years of college, tons of money loaned to you, a once-useful degree, and a highly paid career with just a few minutes of stupidity.

He's going to have a really hard time finding work as a pharmacist after this. His lifestyle and income are about to change dramatically.

the eavesdropping statute has a "savings clause" that makes it illegal for  "Any person to commit any other acts of a nature similar to those set out in paragraphs (1) through (6) of this Code section which invade the privacy of another."

that is what they will hang their hat on.

I would think that up under a skirt would count as out of public view.

You forgot to mention teachers who abuse students.  They get put on 'leave' too.  Can you figure out what Kroger employees, cops, and teachers all have in common?

Lawyers will block the police from accessing the phone.
His defense:  I was adjusting inventory in the store where I work and holding my cell phone in preparation to make a phone call to my delightful mother.  I was going to call her to tell her to save me a seat at church this week but she does that for me every week as I go to church all the time.  Jesus likes that.  Next thing I know, this deranged woman who just picked up her prescription of Xanax and other anti depressants attacked me.  Then, I was handcuffed like a common criminal and taken to jail.  It was a humiliating experience but when you work in the pharmacy, you see people like this whose very mental balance requires extreme medications at all times and it's easy to understand Granny Panties' attack upon my person.

First of all...did he not think should would notice what he was doing? Was he in a trash can disguise?
And secondly...I guess whatever floats your boat, but I can't imagine the pics he would get (if he'd been successful) would be anything that amazing. A dark, grainy photograph of 2 dark blobs that might be lady legs in hosiery with a lighter blob that might be lady's underwear. A GIS could yield you a lot better and you don't have to get arrested and ruin your career over it.
