For once it really was a girl who wanted it and not a sting operation. This girl has parental rebellion issues and she will be lucky to get out of this not pregnant. It may or may not be on her conscience how she screwed over the horny 20 year old for the rest of his sex offender life.

Girls that age aren't capable of thinking that far ahead.
The guy should get some slack, she did lie to him, repeatedly.

And, according to TFA, she also lied to the cops.

Don't think that's going to make a difference here, though...

Not in downstate Virginia it won't.   He'll get 20 years.    The victim being excessively  promiscuous and lying about your age is neither exculpatory nor mitigating int the courts here.

Fake.  There are no 13 year old girls on the internet.

I don't mean to sound crass here, but how in the hell can you mistake a 13 year old for an 18 year old? I think this guy knew exactly what he was getting into and just went along with it. Knowing full well that if questioned, he can say, "She told me she was 18."

Anxiety issues maybe? Might be only able to talk to girls on the internet as opposed to in person.

When officers questioned the two, court papers say the girl lied to police and said she was 18-years-old.

Day is being held in jail without bond.

Lying to the police isn't a crime when you're 13? Who knew?

18 is "Jailbait" to a 20 year old? (Under normal circumstances, I'm saying. Obviously, this one was... because she wasn't actually 18)

JoieD'Zen: Girls that age aren't capable of thinking that far ahead.

It's that sort of attitude that leads kids to think like this one did.

No, you can't stop every kid from doing something stupid, but by the age of 13 you know damn well this sort of thing is wrong even if you lack the maturity to resist doing it. There really ought to be consequences for her. I don't think it's too much that by 13 you're expected to know the bigger rules and held accountable for adhering to them like everyone else. There isn't exactly a lot of nuance in this one, after all. Not with that age difference, anyway.

That being said, I wasn't really a player back in middle school (or high school or college or life in general), so maybe I'm wrong here, but somehow I doubt there are very many 13 year olds out there who can pass as 18 without the person looking at them trying really hard to ignore some telltale signs. Maybe he really did find one of the rare examples, but I'm gonna assume the odds hold here and he just didn't want to drive back home without gettin' some after that trip.

I blame hormones in the food.    At my brother's wedding we noticed this girl dancing with a man I presumed to be her boyfriend or husband.   No, that's her father, she's only 13.

Because he still went through with it when he got there being as they were both found partially nude in his car. 18 is NOT close to 13. It's farking gross. When he got there and saw her he should have said, 'big gulps huh? Welp, see ya later.' And drove off. He's a pedo and gets no sympathy from me.

I've seen some pretty 18-ish 14 year old girls when I was around 20.

But if you're going to drive over state lines for an Internet hookup with a girl that says she's 18, you'd better see some goddamn ID or you'll end up like this guy.

Or she'll have a fake ID and you'll STILL end up like this guy.

It's best that you don't fark any women that look to be under the age of 25.

20 vs '18' isn't really inappropriate. Of course the 18 part wasn't true, but is one really supposed to ask for ID?

Unless they are pasty skinny white girls, latinas and african american girls can be pretty well developed at that age.

Depends on the girl. Some can very easily pass as an 18 year old. Without a pic I can't pass judgment on him.

Still, if the girl is willing to do stuff in a parked car that should have been a red flag. I don't care how horny someone is, there is always time to take a pause and think about it. He had 4 hours during the drive. This is the same from those women that date married men and have, "no idea." They knew, but want to look innocent.

If we still practiced guilt intent, prosecutors wouldn't get the 95% conviction rates. Vague laws and not needing to prove intent is a prosecutors wet dream.

I had a friend who was a prison psychologist from a few counties away (I think Franklin) from where this happened in Virginia.    He tells me that there are many of these guys who believed "you can't rape the willing" and found out the girls were underage after the fact.   The same girl who got farked by one guy now in jail just turns around and looks for her next "boyfriend."

The court system is going to tell you otherwise; you should of known better; she was an "innocent wittle teen girl". He should of kept his sausage in his pants. Many years ago my dad owned the same rental property I have now; I was about 16 or so and one of my tenants was a single mother with a 14 yr old daughter. The second mom went to work; thus biatch was out drinking and smoking weed, of course the guy who was supplying the weed was like 19 or so, she always claimed she "just turned 18". She enough one day she cried "rape" when he wouldn't let her drive his car after she was boozed up.

/Last time I checked he didn't learn from it and actually got arrested again for banging some underage while on probation for the first one!

I think we can all agree that Gifted Many Few has much to learn about the world, but if there's one thing that can be said about an 13-year-old soliciting sex from the Internet before we get to whether or not she looks 18, it's that she's batshiat crazy.  And rule #1 is, don't ever stick your dick in crazy.  Really, just that one rule and this guy would be fine.

Some states allow the "I thought she was 16" defense, but you can't rely on just her own claim that she is 16. You need some other reason to think she was legal.

In most states there is no intent requirement. Where I live it doesn't matter if you had good reason to think she was legal, thought she consented, mistook her for her mom (real case), etc. The supreme court has only recently allowed an "I thought she was sober" defense.

He didn't say private. He said for-profit. Prisons are like hotels - they only get money if the rooms are occupied. Thus, even in government-run facilities, the impetus is to keep the beds full in order to get the sweet, sweet funding.

I have a son who's 14 and let me tell you some of his female classmates are quite well developed and not just talking having some boobs, their face even looks mature and they are tall. Conversely I've seen 20yo that still looked young and have a body of a 12yo boy.

That being said meeting someone over the internet and they look young you may want to start with coffee before dropping your pants.

And if the cheapskate guy had sprung a few bucks for a hotel room rather than farking in a parked car on a residential street he might have gotten away with it.
Saved fifty bucks, cost him twenty years.

I agree that it won't make a difference, but it should.  It sounds like she consistently maintained this "18 year old" scam all through the process until the cops started investigating her.  Now, maybe Pervy McPervison over there could have asked for an ID, or maybe she had a fake, who knows.

But there's definitely a difference here between the guys who fall into those sting operation traps where the "girl" openly admits to being underage (and the guy shows up anyway), and this guy who was basically lied to.

I believe Mr. Rock has already explained this phenomenon to a limited degree:

If a woman tells you she's 20 and looks 16... she's 12
If she tells you she's 26, and LOOKS 26.. she's damn near 40
