Judge Prado's opinion for the majority concludes that license plates reflect the views of the person who displays them on their car, and thus Texas could not exclude the viewpoints of people who support the Confederacy when it decides which plates to offer. There is, indeed, strong precedent indicating that drivers have a First Amendment interest in the message displayed on their license plate. In the 1977 Supreme Court case Wooley v. Maynard, the justices held that a New Hampshire resident could not be required to display the state's motto "Live Free or Die," which was printed on his state-issued license plate, under the First Amendment.

Wonder how many of the folks sporting this plate would be shiattin' bricks if some gays sued Texas to force them to produce license plates reflecting their rich heritage of bonin' folks of the same sex.

The majority opinion by Judge Edward Prado concludes that Texas engaged in impermissible viewpoint discrimination by implicitly disfavoring the view that "the Confederate flag is a symbol of sacrifice, independence, and Southern heritage" and crediting the viewpoint that "the Confederate flag is an inflammatory symbol of hate and oppression."

Given that its the 5th circuit I think we should all just be thankful they didn't mandate confederate flags on all license plates.

Honestly, with the reasoning presented, Texas apparently now has a custom license plate system that they operate through their courts. Pretty much any decision to produce or not produce a plate is some sort of "viewpoint discrimination".

When making a list of reasons why we as a nation should be collectively fired into the sun, this hysteria argument about 1st amendment rights applying to license plates is at the top. I cannot think of a better way for a society to shout out, "We don't have any real problems, and lack the imagination to even come up with a decent fake one!"

Free expression of ideas is a beautiful and cherished thing. However, license plates on cars should be a utilitarian method for identifying your vehicle; full stop. Plaster your car in pro-choice bumper stickers or paint it up like a giant rolling Gadsden flag for all I care. But if you actually feel the need to apply for a special license plate to broadcast your agenda to the world - or God help you, a personalized plate - the DMV should just send someone to your house to beat you unconscious and take your children from you before you can infect them with your stupidity.

Funny thing about that picture: IIRC, after the guy with the flag passed away, his brother actually sought out the black guy to speak to him about the incident, and they became good friends.

Just as we remember the sacrifice of Confederate soldiers we should remember why. They fought against the Constitution. They fought against the Bill of Rights. They fought to protect a way of life that necessitated the enslavement of a significant portion of their population. They caused the bloodiest war in US history before anyone outlawed slavery in the South. They fired the first shots before Lincoln was even sworn in...... Wait, why are these people worthy of honor?

I had heard that. Apparently, the flag guy wasn't a hard core racist, he was just sort of a southie layabout who got sucked into the mob mentality.

Also, the black guy was just on his way to work- he wasn't at the protest at all.

It's hilarious that the "state's rights" thing hangs on in the mythos of the Confederacy, given that the South had used the full power of the federal government to try to prop up slavery in the years before the Civil War.  The Fugitive Slave Act, which obligated authorities in states that had abolished slavery to hunt down runaway slaves, is just the most egregious example.

But, of course, "states rights" has always been the stinkiest load of bullshiat in American politics.

So, if you have first amendment rights on license plates, then all those vanity plates that deemed "offensive" are actually an infringement of my rights? They can only block obscenity and unprotected free speech, but anything that's offensive but not obscene they have to allow.

Looking forward to the IH8___, GR8TITS, etc. plates they'll be issuing in the future.

Why did our ancestors fight to KEEP these morons in the country? Why?? Just think how developed, civilized and generally first-world we'd be without them influencing (sabotaging, really) every facet of government. Creationism in schools, denial of science/reality in general, basically everything that's wrong with America - would just be a minor sideshow in what would be left of the USA, rather than a dominant, crippling force like it is now. Please, just get rid of these idiots once and for all.

I always love getting into conversations with with all the whargarblers about the civil war.  Invariably, they will claim it is about asserting state's rights.  The follow up question that shuts them up every time:

"State's rights to do what, exactly?"

It was the right of states to allow one person to keep another person as property.

It's not even the flag of the Confederacy! That's the Confederate naval ensign, also used by the army of Northern Virginia, but not in that aspect ratio. None of the Confederate states or civil institutions used that flag. It's like even while trying to make a historical "states rights" statement they can't help revising history.

Ok I hate defending Texas, and I am basically not with this post, but..........

Texas has a shiatload of personalized plate options, and they all cost various amounts of moolah, like fairly expensive some of them. For this confed plate here you might spend a hundred bucks, a frickin year mind you, to have that on yer pickemup truck. This is less about racist pride and a lot more about the state squeezing every last dollar out of people without having to stop their glorious ReaGun loving tax cut palooza. Yes the LGBT pride rainbow flag should be an option too, and probably will at some point because it would sell like hotcakes in austin.
