While stringing a cable between two trees is definitely a malicious thing to do, isn't there also a lesson here about not driving your ATV at a high rate of speed along a path you've never been down?

Riding your 2 stroke ATV with the baffles removed at 11PM just because you have a headlight isn't acceptable.

Did the ATV driver already sneak by a more traditional gate?  Multiple signs?

I generally don't have much sympathy for trespassers.  I'm also not a big fan of articles that are written from a single viewpoint.

it's a shame the guy died doing something so simple, but he really should have checked out the path before zooming his atv through a wooded area.  he could have hit a tree root or hit a branch or whatever and been killed that way too.  atv's are dangerous vehicles and he should have checked the path beforehand to make sure it was safe.

If an ATV hits a cable that's a foot off the ground, it's at least going to stop the ATV, causing the rider to fly off and likely be seriously injured.

The intent was to maim or kill whoever was on the ATV, man, woman, or child.

Damn right there should be an investigation.  You can't booby trap your land just because you don't want people on it.

If there had been a big "No Trespassing" Sign or a "Private Property" sign then I would probably say shiat happens.  But a metal wire a foot off the ground sounds more to me like some hunter found a game trail and wanted to break a deer's leg.

I wouldn't think a cable a foot off the ground will kill someone, but clearly I would be wrong.  My guess based on the sentences and sentences of evidence known to us was that it was meant to mess up an ATV but not a person.

and we know its murder why? if it were out there to hurt someone on a 4wheeler, you'd mount it at high chest to clothes line them, not a foot above the ground. Who knows why it was set up originally?

but i'll tell you who doesn't hit stuff and die in the woods- people who don't go flying at high speed on trails they don't know, on property that doesn't belong to them

I wouldn't call it murder - the landowner has every right to put up whatever he wants on his land. The guy was trespassing and he was going too fast. It could have just as easily been a ditch, or a half-buried log, or any of a million other hazards.

However, if this doesn't result in a well-deserved wrongful death suit against the landowner, I will be very surprised. He had something dangerous on his property, took no steps to warn people about it (whether or not they were supposed to be there) and someone died because of it. He needs to pay through the nose.

It wasn't me. But in an odd coincidence, I was just thinking about such a situation less than an hour ago. I was walking in the woods in a place where ATVs sometimes tear things up. I decided if I'm on a jury in a wire trap case, I will expect proof that the dead guy was there legitimately. The judge may exclude such evidence, because legally it's not relevant, and then I'll acquit.

Pretty much this.  And the cable was a foot off the ground and obviously intended to fark up the machine, not the person.  Sucks it worked out that way, and not to sound even more cold hearted but if the rider had chosen to fark up their own land instead of someone else's without their permission, we wouldn't be talking about this.

And if this is anything like a lot of people I know who have river bottom land around here, you can put up signs, fences, whatever to keep the ATV's out, and the idiots just take down the signs, cut your fences, and sometimes even point a gun at you when you confront them.   They tear shiat up, sometimes put livestock in danger, and I doubt anyone around here would hold a land owner liable for an injury to a trespasser hurt while trespassing.

It's against the law to booby trap your property.   If you want to keep off trespassers, you can post a guard, or build a proper fence, but you CAN'T set up razor wire, land mines, moats filled with alligators, etc,  This is illegal everywhere, even in fark-tard Southron states. On the other hand the ATV rider was probably a good ol' boy Tea-Party supporters, so karma.
