It is my opinion that towing companies aren't regulated nearly enough. This guy should have been caught the moment he showed up an an impound yard without the right paperwork.

This guy's a real piece of shiat. I say we all turn our backs for a few minutes to look at some pretty flowers or cat pictures while the police punch him in the head a few dozen times. He's a slimy predator that deserves to have the shiat kicked out of him every single damned day. Frankly, if he's shivved in prison, we should all consider writing a thank-you note to the con who does it, because it sure seems like all this guy lives to do is bring misery to others.

What really legally prevents you from just going in and repossesing your own car?

The Irresponsible Captain: It is my opinion that towing companies aren't regulated nearly enough. This guy should have been caught the moment he showed up an an impound yard without the right paperwork.

Oh, they're definitely not regulated enough.

And for the most part, they're as immune to the law as the cops are.

Where I am, to legally tow a car from private property, a tow company must have the written authorization to tow that specific car, either from the vehicle owner or the property owner.  If it's not the car owner authorizing the tow, there must either be a sign indicating the parking policy or the car must have been there for 10 days.  It is a misdemeanor to tow a car without written authorization.  It's also a misdemeanor to fail to contact the police and the car owner after the car is towed, and it's illegal to collect storage charges if they fail to do so.

These laws are utterly ignored.  Tow trucks roam parking lots near the local university campus looking for cars to tow, they routinely do "grab and go" tows with no paperwork, they tow from parking lots with no signage, they don't contact anyone about the tow, and they are NEVER prosecuted.  If your car is stolen by these scumbags, they force you to sign a waiver of your right to sue before they'll return your stolen car.

The local judges routinely dismiss lawsuits against towing companies, and taking a towing case to the Court of Appeals will in many cases cost you more than the value of the car, with no guarantee that you'll get anywhere.

I don't get it.

What I am not understanding, what legal authority do they have to take your car, and demand money to return it? What legal authority do they have from preventing you from taking what is yours?

Yeah well, I had that comming.

To me it seems incomprehensible how a private company can take your property, based on an infraction you made towards a third entity.

Answers:

None.

They have a truck, a boot, and a lock on the gate. That's it.

They'll keep doing it and the cops will keep letting them get away with it, and the only way we as a society can stop them if by forming a mob and beating them with bars of soap in sweatsocks.

I think the towing business would fade away if they saw some mob justice.

They are allowed by state law to hold it if it was legally towed. If you take it without paying, you're now stealing the fee and in a shiat load of trouble over a parking ticket and tow.

So if your car broke down on the side of the road, how would you get it home, or to the repair shop? Who would the police call to remove wrecked vehicles? Who would pull cars out of ditches when the roads get icy?

Make no mistake, the towing industry isn't JUST about impounding vehicles, and it ain't going away.

This happened to me once. I parked in a lot that had no signage indicating the spot i parked in (or the lot itself) was permit only.   There were signs on some of the spots in the lot, but that's it.

The guy towed my car to a lot, then refused to tell me where it was, only saying he would bring my car back if i paid him $350 cash on the spot.  Initially i thought my car was stolen (i called the police) until I saw him towing others.

I tried following the guy after he towed another car, but he pulled over and said not to follow him.  It got very heated.  Eventually  I caved and ended up paying him.

I've since followed him to his lot which is unguarded and approximately 3 blocks from where my car was.  I then put a review on google letting others in this situation know that they can just go to the parking lot he put the car in and drive away.  hopefully my advice can help others out.

/still bitter
//Now I drive an ex-cop car which is hopefully more immune to scum bag tow operations.

After reading the interview with the wife, my takeaway is that this guy missed his calling.

It's called acting. Take your equipment and uniforms to hollywood. Be a prop shop while auditioning/acting as cop/emt/fireman and you get to play out your fantasy all day long. Just not in real life.

a few CSBs about towing companies I've seen:
1. The time a girl jumped into her car right before it was lifted on a tow truck and managed to get her friends talk scream/talk the guy out of towing her because of liability.
2. The time I saw a tow truck pick up a car, drive about ten feet, smash it into a dumpster... get out, survey the damage, and put the car back where he found it and drive away from the scene.
3. My own experience with an unmarked space where the tow truck driver lifted my car, damaged the bumper and refused to take it off his truck. He then refused to give me his insurance and tried to claim it was like that before he picked it up. (I had two friends with me and several people from the restaurant I was at who saw the whole thing). I called the police (just so happened to be friends with one of the local cops), they came and made him give me his insurance. Months later he told his insurance he wasn't evening towing that night, then when I told them I had several witnesses and two of them were cops, they came back to him, and he *still* denied it. -So then I sent them the cell phone picture I took of *his* tow truck with *him* right next to it with my car (he tried to get out of the picture, but I caught him before he could).

/incidentally, if you are ever in this same situation... take pictures, tons of them, of the tow truck and driver with your car, and any witnesses that happen to be there as well.

Then again maybe it caused problems for the property owner...but still. And I wonder if they did any shopping there on the way out.
