There's a street near downtown Helena, MT, that is 'famous' for this sort of thing.  just as you get to the top, it drops at about a -45 degree angle.  At the bottom of the 'hill' there is a railroad trestle.  Kids were always speeding up the street to see how much air they could catch going over the top, and how much they could terrify their passengers.  One guy went WAY too fast, bounced when he came down, right into the railroad trestle.  cops figured he hit going more than 60mph.  Ouchie ;)

So, by extent, Hogue knew the road very well, knew there was no lighting, knew it was 'cloudy at night' ,ie. dark, and did it anyway. This makes the attorney's 'defense' a patently stupid and blatantly misleading.
I recommend the time awarded to the defendant be split in two and the attorney share the cell with the defendant. Perhaps next time he won't be so stupid to blame his defendant's actions on 'the dark'.

That said, it really is a sad, stupid accident done by a kid not thinking of ramifications and possibilities; he sure as hell didn't do it on purpose...
I've jumped cars, motorcycles and even boats getting my thrills but rarely risking anyone else though. I got lucky 99% of the time and never hurt anyone but myself, so I'll take my lumps.

Be careful kids, Darwin, the World and the Universe really don't care if you are part of things and probably the biggest danger to you is yourself; so wear protection when you masturbate...

If I were casting a moving about frat boys from a lacrosse team that go to a Linkin Park concert where they drink Kettle One and score some top shelf pussy, I'd put this guy in the lead role.
