UndeadPoetsSociety: kronicfeld: PhiloeBedoe: If he is sending unsolicited dick pics to anyone, no matter the age of the person he sends them to, he certainly should be in trouble.  He shouldn't be made erect and photographed but there should be other ways of proving whether or not he sent them...

They've already seized the kids' electronic devices. They are really trying to prove it is HIS penis, not just A penis.

Why does it matter whose penis it is?  The girl said "Don't send me dick pics"; he sent dick pics.  Case closed.  Whose dick they were pictures of is totally irrelevant, only whether they were sent from his phone or not.

According to more than one article it was the girl's mother who told the boy to stop sending dick pics.

"He said they took him to a room and took pictures of his genitalia," Bigley said. "I asked if they're allowed to do that, and [Trey] said, 'I tried to refuse,'" which he did, he didn't want to do it. They told him if he did not they would do it by force."

I think I've seen that one...three burly bear cops manhandle and force a cute little twink to the ground, lustfully ripping his pants off, then one yanks his underwear down with his teeth while the other is holding him down by his thighs. The twink writhes and moans but one grabs his cock and barks "Aha! Here's what we came for. Get a picture Lou!"

(Of course, in that porn he's really an 18 yo model that just looks 17)

Because if it's a 6570 day old penis it's just harassment and not child pornography, but if it's a 6569 day old penis, it's felony child pornography.

More so the prosecutor who is trying to make a case against him in the first place.  There needs to be an exception in child pornography laws for voluntarily sent 'selfies' amongst minors.

Well the girl wasn't charged for doing the same thing, so I guess the exception involves being a girl.

PhiloeBedoe: there should be other ways of proving whether or not he sent them

They're not prosecuting him for providing porn to a minor (which isn't a felony, generally speaking). They're prosecuting him for taking pictures of himself and for having pictures he took of himself.

When are we going to stop putting mirrors in bedrooms and bathrooms? Won't someone think of (new ways to imprison) the children?

UndeadPoetsSociety: Why does it matter whose penis it is?

That's not the case they brought. They're charging him with having pictures of his penis. There are no charges related to sending the images to anyone of any age.

Delay: What the fark is wrong with police today? Police get enormous pensions that we pay for, they bust peaceful people with a gram of marijuana and those hippies go to jail for life in prison, the police extort normal people and plant drugs on them when those normal people have done nothing wrong, then, when it all quiets down, the police shoot their dogs. Who are the folks that profit from this?

The police woudl likely arrest the doctor/nurse for nto doing it.

An emergency-room nurse at the West Palm Beach Veterans Administration Medical Center said she was just following hospital policy when she told a Palm Beach County sheriff's deputy she couldn't draw blood from a suspected drunken driver.

Minutes later, Marjorie Lachaud-DePalis was slapped in handcuffs, led to a patrol car and charged with obstructing justice.

Jesus Christ, I thought this was going to be a clever pun - like they were building a treehouse for a terminally-ill teen or something. This is horrific!

"The teen is facing two felony charges, for possession of child pornography and manufacturing child pornography"

So they want to (by their definition) manufacture child pornography themeselves in order to prove it? Madness!

"the case began when the teen's 15-year-old girlfriend sent photos of herself to the 17-year-old, who in turn sent her the video in question. The girl has not been charged"

Of course not.

I don't think that is the case.
The case was dismissed, but police immediately obtained new charges and also a search warrant for his home. Police also arrested the teen and took him to juvenile jail, where Foster said they took photos of the teen's genitals against his will.

I don't know what the new charges are.

This reminds me of the scene in Porky's when Ms. Balbricker got her hands on a boy's manhood and wanted a police line-up to identfy him.  Maybe Coach Brakett's  recomendation that they call the police, and have 'em send over one of their sketch artists so Miss Balbricker can give a description. He then suggests that the put up "Wanted" posters all over school saying, "Have you seen this prick? Report immediately to Beulah Balbricker. Do not attempt to apprehend this prick, as it is armed and dangerous. It was last seen hanging out in the girls' locker room at Angel Beach High School."

Let's see.....   the doctor has the choice of violating a minor's rights and performing an unnecessary medical procedure this risking his license OR standing pu to the cops and spending a few hours in jail.

I guess a doctor could decide either way. But if it was MY kid the next step would be to lawyer up, bring it too the attention of the medical board, sue the hospital, and sue the doc for malpractice. I can guarantee you that my actions would be more unpleasant than spending a few hours in the local jail.

Not a fight I'd care to step into, but a few thoughts.
Back in the day, for the most part, the only "documentation" of teens being   irresponsible   teens was that poor Catholic girl who was sent out of state for an extended stay with relatives who came back looking a little different. Additionally, the magical power of the typical boomer's older siblings/cousins/etc. to pound the living snot out of those who decided to, uh, "kiss" and tell kept the rumors and damage to reputations limited.

Many of the counterbalances we had then have been wiped away by technology and social changes. Bullies have the ability to reach a far greater audience now. As freetomato pointed out, we have always had AWs (and people going through an AW stage) among us, but they were able to put the past behind them as they grew up. Since the internet never forgets, this isn't true any more.

Additionally, the inexplicable change in our attitude and policies from reforming, giving second chances, and judges using judgment to permanent punishment, intrusive parole, zero tolerance, draconian punishments, and mandatory sentences means that far fewer people are able to pay their debt to society and move on. It's injustice writ large that we have as many citizens imprisoned as we have military personnel, including the Guard and Reserves.

I'm surprised they didn't charge the aunt with obstruction of justice, although sending the kid out of state was a smart move. The defense could have forced an extradition hearing if those evil dirtbags tried to force him to return so they could execute their warrant.

Still, that a judge even signed that warrant stands as a symbol of how unfaithful the government has been to its people.
