U.S. Patent Office has canceled trademarks belonging to the Redskins

The decision came in response to a suit brought by five Native Americans.

But

The Patent Office said it would not enforce the ruling, pending an appeal by the team.

The decision, if upheld, would make it harder for the team to claim ownership of its brand. If it wants to go to court against a counterfeiter making T-shirts with the team's logo, for instance, it will be harder to show that the organizations owns the brand. The team will have to illustrate that they have always used the logos, rather than relying official trademark registrations.

The team will also be allowed to continue using the logos.

The board also canceled the registrations in 1999, but a federal judge overturned that decision in 2003, saying there was no proof that the name was disparaging at the time of registration. Some of the patents date back to the 1960s.

Yeah this is not the first time this has happened, although this group of plaintiffs is far better formed than the last ones, specifically to avoid the problem from the prior attempt.

I thought the Bullets could change to the Washington Homeless, but it could work for the 'Skins too.  Call the team the Homies.  Every week, you get a new homeless guy to be your mascot.  You hose him down in the locker room.  You give him a bunch of clean clothes (team-branded schwag, sweatpants, heavy jackets).  You feed him on game day.  You let him flip the coin to see who kicks off.  Sunday night, you buy him a cab to his favorite shelter and make a $5k donation in his name.

Probably, the standard for determining a disparaging mark would likley not affect a team like the Indians per se, although certain versions of Wahoo probably could have been problematic.

CSB, time: I remember mentioning to my parents in 1992 that the name "Redskins" was inherently racist and should be changed. They freaked out and we got into an argument about it, which struck me as weird, as they were somewhat left-leaning about such matters. I thought it was pretty obvious, no one would ever name a team "Atlanta Darkies" or "San Franscisco Yellow Peril" but somehow "Washington Redskins" was A-OK? I was nonplussed.

That's why I'm not surprised it took this long.
