The delay came as students were transitioning from dorms during the spring semester to off-campus housing, meaning they needed the checks to pay deposits and rent.

Not subby but his reading comprehension seems better than yours.

Not legally. She consented and he did not lie as to his identity. Would you charge someone with rape if you found out their pickup line was a lie and they did not in fact own a Ferrari?

Well.....technically....blah blah blah........

He did lie about his identity when he wore the poor man's version of a Darth Vader mask, and she called him Stan, and he didn't correct her.

But my inner lawyer is telling me that her happy reaction afterwards....when she knew it was Louis.....counted as retroactive consent.

True, it was pretty crappy. In any event back in the 80's pretending to be someone else wasn't rape, even if the chick was blackout drunk.

At breakfast, my Dad tried to turn the movie into a lesson about how important it is to be smart.  With the thick Coke bottle glasses I wore back then, he probably saw me as a future member of Lambda Lambda Lambda.

This is the saddest part.

Jay said NCAA rules restricted the school's options to solve the problem, meaning he couldn't buy the athletes groceries or take them out for meals.

"You could be looking at a potential NCAA violation by doing that," he said. "You have to look within the limits."

So the school makes a mistake affecting these guy's and the school isn't even allowed to take steps to reduce the impact they caused on these guys by providing them food until they resolve their own mistake. That is just ridiculous. I bet if the NCAA wanted to be hard asses they could even go after them for letting them sleep in the locker room.

So he stole the mask knowing it would trick the girl into thinking he was someone else. Then, knowing he had tricked her into thinking he was her boyfriend he had sex with her and that isn't rape?

I think the key difference is he was pretending to be the person's boyfriend. It wasn't about pretending to have a lot of money or power. It was about pretending to be an actual different person.

In California that still wasn't rape until last year, unless she was married.

California law now clarifies that "an attacker who coerces a victim into sexual activity by impersonating somebody else can be prosecuted for felony rape," according to a state lawmaker's news release.

From nationalparalegal.edu:

However, if the defendant tricked the victim in regard to his identity and the trickery does not involve a marriage relationship, this type of fraud will not render the intercourse rape. For example:
Joe and his fiance Marilyn and Jack and his fiance Jackie decide to go away for the weekend together. They rent a small cabin by a lake where they plan to spend the weekend hiking and fishing. Joe and Marilyn are occupying one room in the cabin, and Jack and Jackie are occupying the other. One night, Jack decides to do some night fishing. While he is away, Joe sneaks into his room and, under cover of darkness, pretends to be Jack. Joe and Jackie then proceed to engage in sexual intercourse. In this case, Joe's trickery was with regard to his identity. Therefore, since it does not involve a marital relationship, the sexual intercourse that he has with Jackie is not considered rape.

Good lord. Please tell me you're trolling and not that much of an idiot.

There is a substantive difference between telling lies about yourself and actually impersonating someone else to have sex. And no, we're not talking about giving a false name or pretending to be a Hollywood actor you vaguely resemble. In the movie he knowingly takes advantage of her reasonable assumption that it's her boyfriend under the mask. That's culpable fraud and sexual assault. No matter how much you root for the nerd.

It's usually in the edited versions. The nerd winds up wearing the mask the blond sorority girl's boyfriend was wearing. She mistakes him for her boyfriend and pulls him into a room for some fun time. He goes down on her and she doesn't realize until after, at which point she has him arrested for sexual assault-- no, right, this is a Hollywood script-- his heretofor-untested skills cause her to fall madly in love with him.
