"Army member Bowe Bergdahl "who did not earn the rank of SGT" went AWOL / Deserted the United States Army in June 2009. Punish Bowe Bergdahl for walking off base with intent to not support the War On terror. Bowe Bergdahl broke several Articles under the Uniform Code of Military Justice and needs to be punished not rewarded.

You detractors here are forgetting that another court exists in the United States of America. It is frequently overlooked, often ignored when it should be seen as setting important precedent, and its authority is too frequently ignored by lower courts and that is the court of public opinion.

People seem to forget that we live in a democracy, and in a democracy the "will of the people" is supposed to be the highest law of the land. Only now we hve activist judges and activist juries who put themselves above public opinion and so scofflaws like George Zimmerman, O.J. Simpson and Casey Anthony are unjustly set free.

But now we the people are waking up again. We are realizing that our voices, not the voices of an unelected few members of a jury, are the ones that should be counted. We have begun holding our own legal proceedings, and our movement is growing. It is underground right now, and that is why you may not be able to see it. Soon, however, our movement will grow so much that it will break out of the ground and then you will witness us harvest our potato.

Why would it make Obama look bad?  If he is in fact guilty of desertion, he should be prosecuted for that on American soil under American military law.  Depending on the circumstances, not getting him back is either letting him get away with a potential crime, or punishing him without a trial.  Not the way we should be doing business in either case.

Military law and civil law are not necessarily equivalent.  You can break military law and the entire event can be retroactively authorized or dismissed. A trial for desertion in this particular case is not in the best interests of the service.  An absence of a short period of time can be dealt with administratively at a fairly low command level. If a guy does not show up for several days, he can be dealt with at a unit level.  His commanding officer can dismiss any charges with no more punishment than counseling if he/she deems it appropriate.  This sodier was not an unexcused absence for 5 years.  He was a known POW and was likely mustered as such.  I am not sure how long he was missing before it was discovered that he was in enemy hands. His unexcused absence was likely only for a few days, and then was explained as becomeing a POW.  The circumstances surrounding his leaving the base are not settled and will likely not be disclosed. We only have unauthorized conjecture to condemn him with publicly.

Often in the military, when you do something you were told not to do and it ends up quite badly for you, you get left off with the life lessons as your only punishment.  If a guy wanders off a cleared path and gets a leg blown off, we basically let that serve as punishment enough.  This guy may have hated the military, his country, and sympathized with the enemy, and left his post, all things that can lead to various levels of military punishment.  Unfortunately for him, before the military could deal with him, his actions lead to capture by the enemy.

It is entirely appropriate for the military to waive any charges of wrongdoing at this point.

The military does not require that all members love and honor the service.  They only require obedience.  His published statements regarding how he felt about the United States and the military's mission are really not relavant at this point.  Many soldiers question their missions over time.

My understanding is that if the petition gets to 100000 votes, Obama will personally rip Bergdahl's heart out on national television, at which point the GOP will go apesh*t that Obama killed one of their own.
