Can't you just put a notice in the news paper a couple of times.  If you don't show up for your divorce, then the judge sends you to splitsville in absentia?

Used to be big business for the court newspapers.
"Mary Freakstorm, address, is seeking to petition the courts for a Decree of Divorce from Harry Freakstorm, last known address.  The court has scheduled a hearing on this date and both parties are to appear before Judge .

Run the classified ad a few times.  Show up at the right time, tell the judge your side of the story and he grants you a divorce.

Since this guy's in the pen it may not work.

But in this case, they theoretically know where the defendant is.  I thought service via publication of notice was in cases where the defendant can not be located.

I would think you could serve notice on the US Marshall's Service or the Bureau of Prisons or somebody/department at the Justice Department.

It took a few months to sort out which federal official could even accept service of the divorce papers and pass them on to Rothstein, though it seems that he was served sometime between April 23 and May 9, Morris wrote.

He was served.

Generally speaking yes.  However I think alternative service is called for in this case.   Back when I helped run a family court I think we'd have gone with  "service by Publication" and a certified mail copy to the the Bureau of Prisons.  Since he is technically in their custody, it would be reasonable to designate them to accept service on his behalf

Meh, doesn't matter anyway.  The defendant was served, apparently, just not in the time frame specified by the laws of that state.  Judge wants to dismiss based on that.  Now that Plaintiff and counsel knows how to serve him, IF the case is dismissed, just refile and serve in the time specified.  *shrug*

This article is complete bunk anyway.  It doesn't say they can NOT divorce, only that the case may be dismissed on a technicality.  It can be refiled and she'll get her divorce eventually.  She's in prison right now anyway, not like there's a time bomb ticking for her.

So lets see here. Husband is in fed prison for fraud, and she is one of those money grubbers who thought everything was falling apart and hid her piece who got some time for it. She gets half of what he has (over a billion), which is probably all fraud money. Feds then seize all money from both sides (because fraud money), and both go away for a while, one getting nothing, the other losing everything.

Works for me.

He's in prison for the next 50 years, why does he need witness protection in prison?  They would already have him separated from anyone that would harm him, buy why cut him from all contact?  Just seems odd they can't have the papers sent to him to finalize and call it done.  There can't be any property left to dispute, or any way he could dispute child custody if there were any children.  It take a day or two longer, but just get the papers to him wherever he is and get it over with.
