You know, given how vaulted our American judicial system is supposed to be, it's remarkable how much if it all goes down to what sort of mood the judge is in today.

And of course, NO CHARGES FILED. The judge went right back into court to pass judgment on people accused of crimes like the one HE JUST COMMITTED. Great job by the PD on his 6th Amendment record and his refusal to back down.

This, so much.

Anyone else would be arrested. But if you're part of the system you get a free pass.

I hope everyone whose case was heard by this judge after this incident appeals on some basis involving the judge being unfit for his office.

Yah, IANAL but I'm pretty sure "battery by the presiding judge" might be grounds for getting the case tossed.

so the judge got mad when the defense atty didn't waive his client's rights like he wanted him to?
yeah he needs to be disbarred.

2014-06-03 02:29:06 AM
What do you call a public defender in Florida with two black eyes?

Nothing because the judge told him twice to have his client waive his right to a speedy trial.

2014-06-03 02:40:34 AM
Wow, talk about lack of decorum.  The judge was in contempt of his own court!

Meanwhile, telling the attorney to waive a statutory or due process right would be bad enough for a reprimand from the state bar but the right to a speedy trial is enumerated in the goddamned Bill of farking Rights.  Screw the assault, this judge is not qualified to practice law.  Disbar his'oners ass.

"vaulted" was really bugging me. I'm sick of people blaming their auto correct programs instead of proof reading the gibberish they post. YOUR AUTO CORRECT PROGRAM SUCKS - GET A CLUE AND PROOF READ. And I'm giving the OP the benefit of the doubt by believing s/he meant to post vaunted and not vaulted.

Try learning to capitalize the first letter of a sentence before correcting others. I am sick and tired of people correcting others when they can't write themselves. Oh, and starting sentence with a period? What the hell?

Just blame it on autocorrect and move on.

The word was in quotes, and I left it in lower case because that is how it appeared in the sentence. Would you have preferred "[V]aulted"? Would that have been acceptable? I don't think it scans well.
Not sure what you are referring to when you say "starting sentence with a period".
I'm not a grammar Nazi nor do I complain about people confusing homophones like there and their and they're. Life's too short. Does my dislike of auto correct offend you? Are you offended?

Well.

I guess anyone who goes in front of that judge can get the judge to recuse himself.

"I ask the judge recuse himself?"

"on what grounds?"

"I have a lawyer, and the judge has a record of assaulting and battering attorneys, showing an obvious bias."

"sustained."

Why wouldn't the bailiff automatically arrest the Judge for obvious contempt of court? Because the judge didn't call for it?

By the logic of this situation, judges can assault people in their court room while trying to bully lawyers into waiving the rights of their clients that are guaranteed by the Bill of Rights.

That is what was illustrated here, in full.

If the lawyer started this...

You'd think so, wouldn't you? According to my GED in law, judges don't always have to recuse themselves. It's anecdotal evidence, but we have a local judge who supposedly presided over his own son's child custody hearing years ago. Guess who won custody of the kid? The judge's son or the ex-daughter-in-law?

The judge is the court, without the judge, it is just a room.  They can't be arrested for contempt of themselves unless they order it.  And I don't think a bailiff can arrest anyone inside the courtroom, unless the judge orders it.  And they can't arrest him when the lawyer didn't call for charges to be pressed, especially since they didn't witness the altercation.  The latter part is the bigger reason why he wasn't taken into custody.  I think the lawyer will be happy just having the judge debenched.  Besides, we've all seen judges don't ever face the real punishment for their crimes, so I'm with the lawyer on this one.  Start chanting, there goes a judge, there goes a judge, one less judge.

From the Sun Sentinel's endorsement of this assclown:

John J. Murphy III should be elected to replace incumbent Judge Joyce Anne Maines-Julian.
Murphy, 49, of Davie, has been a lawyer for 25 years, and worked from 1977 to 1978 as a Broward County assistant state attorney. He now owns his own law firm.

Murphy has a reputation as someone who exercises the highest possible standards of conduct, both in public and private life. He is a low-key person who quietly does his job and volunteers help to community causes without seeking public attention. His volunteer work includes donating time to Broward Lawyers Care, working at no fee for several years on three guardianship cases, and donating time as legal adviser to Liberia Economic and Social Development Inc., a nonprofit gorup helping poor families get affordable housing. He is past president of the Hollywood/Sunrise Kiwanis Club.

If elected, he promises to be fair, impartial, diligent and dignified. He believes clogged court dockets are a major weakness facing the judiciary. He would encourage defense and prosecution attorneys to meet regularly to discuss their cases and try to resolve issues before going to court.

What's worse is they were fighting. FTFA: Murphy allegedly [sic, on video in public] pressured Weinstock to get his client to waive his right to a speedy trial.

Then the judge sucker-punched him: "The attorney said that immediately upon entering the hallway he was grabbed by the collar and began to be struck," said Blaise Trettis, public defender of the 18th Judicial Court. "There was no discussion, no talk, not even time for anything. Just as soon as they're in the hallway, the attorney was grabbed."
But hey, y'all would rather Strunk & White each other all day. A pity.
