I enjoyed how the article helpfully points out the (twice, if you count the subhead) 0.08 limit for being considered DUI/DWI/OUI, but nowhere does it say she drove or is being charged with DUI.

The article says she was "leaning against a car to keep her balance."

So she was in control of a motor vehicle as defined by some DUI statutes.

When I was working in the ER in Baltimore City, I had a guy come in who had been stabbed in the shoulder, and was remarkably lucid for someone whose BAC came back at .42.

Yeah, she could have walked there.

I'm guessing she probably did, because she'd had an accident in a car before making it there.

Why do they measure her BAC if she's not driving though?

Yeah, this is a serious alcoholic.  Someone who only has the occassional drink wouldn't survive this.  Tolerance.  I'm a well seasoned drunk and that level would leave even me at the very least passed out.

Given that the story says she previously blew a .462, I'd say her body is better adapted for drinking that amateur frat boys.

I've always wondered what I would have registered (was going to say "blown", but, I would have been the butt of many amusing comments, NTTAWWT) at various time in my life.  I once did a bottle of Wild Turkey 101, in a couple of hours, at a casual get together, and then went to the bar for the regular Friday evening frivolity.  Those where the days when, as the doctors would say, I was self-medicating.

Nice story but a .439 indicates an invalid reading.
The machine is broken.
In most states the DWI/DUI laws provide for conviction for a test above .08 or "loss of normal mental and physical faculties"
So they'll still be able to convict her, but they should have the machine serviced immediately

Not necessarily broken.  From what I've read online from different cop blogs, the readings go higher than .500 on some machines.  I think they have to do blood analysis to pinpoint the correct percentage or something though.

If you still have straight volatile alcohol in your mouth you can get readings as high as +0.8 without your true BAC being nearly that high and  you would be dead if it was. The more ya know!
