A little less hyperbole would be welcome

Smith's "actions contributed to the demand for these horrific images of child abuse," Ellsworth said in court papers. "Every participant in the chain - producer, distributor, consumer - sustains the market for these images, and each victim, whether identified or not, suffers not only when an image of him or her is created, but each and every time an image of him or her is viewed."

If that's true, they just qualified for the James Randi prize and need to step forward to share in the million dollars.

Sounds like this guy needs to be in jail, but I couldn't care less about him "failing" a "lie detector" test.  When are we as a society going to realize those things are voodoo and just throw them all away?

Normally, idgaf... the cp was already made, and I think pot should be legal... but I'm kinda concerned about him not being able to answer honestly about that whole did he ever actually assault a kid thing... so throw his ass in jail for as long as you possibly can under whatever charges you can. I have no sympathy for kiddie diddlers, though I wish him no ill (unlike others, I'm not a fan of prison violence), he needs to be removed from society asap and for as long as possible so he doesn't hurt anyone else.

I hope the authorities are able to locate whatever kids he did rape and file appropriate charges for them.

He's a guy with sexual proclivities towards children who is about to go to jail for a very long time, combined with his (apparent) dishonesty when answering whether or not he has sexually assaulted children personally... I wouldn't release him if I was that judge... too great of a chance of him having one last hurrah.

I think because most Farkers decide to go for either Pedobear or Chris Hansen jokes/references more easily than Donnie Darko (except when it comes to Frank the Rabbit).

spawn73: Oh noes, think of that pot he'll smoke, and all those pictures he'll view while out!

The pot is irrelevant. The fact he is continuing the victimization of abused children by trading the pictures of their violation, and that he poses a danger to society of acting on those urges as a pedophile is the relevant matter here.

I would have remanded him to a psych facility pending trial, were I a judge.

Most pedophiles are sociopaths as well.

What is the mechanism of this continued victimization? Are the victims psychic? How else would they know about the trading of images -- an illegal activity that those involved with conceal?

An argument sometimes presented is that mere possession of child pornography should not necessarily be actionable, or at least not as actionable, as the act of creating it.

The counterargument is that the mere existence of child pornography creates a (black) market for a product whose manufacture inherently causes harm to children, justifying severely criminalizing even possession of it.

/Oddly, I initially read that argument in a discussion of gun control.

How many people do you know who are aware when - unknown to them - some stranger is laughing at their High School yearbook picture?

Really? You're that disingenuous?

Let's replace this with another situation: You are anally raped by another male, who takes pictures of your rape and spreads them across the internet. Would you not be victimized psychologically and criminally by this? Would this not warrant increased criminal punishment?

Child porn victimizes a child for the rest of their life by spreading the visuals of that victimization across the internet for everyone to see. In addition, it further fuels the victimization of other children by creating a market for pedophiles to trade the videos and photos of their exploits. It goes beyond the concept of a "thought crime" by perpetuating a continued victimization of the abusee.

That victim lives the rest of his or her life knowing the pictures and videos of his or her non-consensual abuse are out there on the internet for pedos to spank to.

A high school yearbook photo is quite different than the photos of you raping a five year old.

The point I was making was that the victim is not re-victimized "each and every time" someone views one of those images as the prosecutor claimed. Barring psychic abilities, the victims have no way to know of the individual viewings and hence cannot be harmed by them in an individualized manner.

That the images exist in the wild and are presumably viewed by some people is an entirely different matter, and no doubt a source of distress. If anything, the prosecutor emphasizing that they are available to those so inclined contributes to the distress of the victim.

The prosecutor also said "identified or not"

If I were victimized as in the scenario presented by hardinparamedic, The proper analogy would be for me to feel victimized by people sharing images of other or unidentified people being raped. Not quite the same thing.
