So raping wives is unpossible?

The poor write up on that raped my brain.  And ThinkProgress will probably get off scot free.

Wise was sentenced by an Indiana county judge to eight years of home confinement, and the remaining 12 years of his 20-year sentence suspended.

I'm going to assume that his home is located somewhere in a pond of paper mill effluent in the middle of fire ant country, otherwise this story makes no sense.

Well if she slept through it all, what's the problem?

2014-05-20 05:29:53 PM
After she found videos of sexual encounters on Wise's cell phone and confronted him, he wrote in an email to her, "I was taking advantage of you in your sleep and you kept coming to me and telling me it was NOT ok. I needed to stop." The rapes went on for more than three years unbeknownst to Boardman.

Putting aside what an odd email that is, you even have an admission of guilt.  Totes cray cray.

Guilt to what, though, is the real question?

The rape is secondary here. The man's a POISONER. AND ADMITTED POISONER. That's a lot worse. Not quite by a factor of 10, but if we assume that rape is Bad with a capital b then poisoning is BAd with a capital b a. So whatever mob you've got planned, add another 30% more pitchforks and torches.

FTFA: Marion Superior Court Judge Kurt Eisgruber declined to explain his reasoning, particularly because Boardman is appealing the sentence.

Aren't these the kinds of times where you should really require the judge to explain the reasoning--especially when its being appealed?

All I know is I don't practice criminal law and I'm happy with the civil bench in Marion County.

If the judge was appointed you'd have no recourse, at least they can be voted out of office next election cycle.

We need accountability in law enforcement. Meaning the public should have a process to jerk anyone out of power if they abuse that power.

Of course, there needs to be safeguards against abuse of such a process, but the fact is we can impeach the president, so anyone lower on the totem poll, which is everyone, should be vulnerable to a similar process regardless of how they got the position. Apointee, elected official, winning a lottery: whatever. If they mess up bad, we need to have a big hooked stick to reach out and drag em off stage.

And anyone who admited to drugging and raping someone multiple times? Letting them out in the world with normal people without even an in depth explaination as to your reasoning is an abuse of judicial power.

Maybe there's more to this story we, the public, are not privy to. Details that came out during the trial omitted from the article. But I doubt it.

What? no. thats not how appointed judges work. Well not in non-retarded countries.

The idiocy of your supreme court is not even a bit typical.

You can't expect a for profit prison to make money off a 50+ year old serving 40 years, they've not got that much productive time left and will start to cost a lot of money for medical resources soon. But a teenager capable of decades of productive labor...

Good ole American justice at its finest..... Again.... Guys like this need to be executed and the dumbass judges as well. I am really wanting to know the screening process, if any, for those we appoint as judges because we're doing it wrong.

Not to the media.  The appeal makes it an open case, so the judge won't/can't talk about it publicly.

Obryn: She obviously wasn't taking care of her biblically commanded requirements.

That's what it was, some damn holy roller bible thumper as a judge. New prerequisite for being a judge should be: no religious affiliation what so ever. That will eliminate any sort of personal bias and belief from the system.

It does suck when your spouse begins to jump ahead on episodes and even entire seasons of shows on Netflix that you were supposed to watch together, but drugging and raping them in retaliation is a bit much.

I'm sure Hallmark makes a card for just such an occasion,

inside: "but hey, it's not like I was secretly banging queers. Yours in Christ, __________"

It tends to be dark blue districts that let the child molesters off. My guess is dark blue here too.

I wonder how the judge would feel if the crime "rape" were replaced with "downloaded mp3s illegally."

I'm guessing the judge would care less about his remorse and probably not expect the victims to apologize.

Repeatedly drugged and raped his wife, and his "punishment" is house arrest?

He sounds rich and white.

haemaker: ginandbacon: Judges should not be elected.

On the other hand, elected judges can end up getting voted out of office for making unpopular rulings, like saying that gay couples can get married.

I disagree. No religious test, et cetera....

2014-05-20 08:20:11 PM
The judges reasoning is that if she as his wife were doing her wifely duties then he wouldn't have had to drug and rape her so it's really more her fault than anyone else's,  and not really rape.

/rape

Baseless assertions aside, the case came from Indianapolis, currently the second largest city in America with a Republican mayor and part of a rather Republican state.

I wonder how many of the judges that are giving out these nothing sentences for rape also prescribe to the belief that rape cannot lead to pregnancy because the female body has away to shut the reproductive system down during rape. More people, supposedly intelligent people, believe that than you realize. I never realized how many until that crazy guy from Missouri made national news for saying. After that I heard a lot of people defending it like it was common knowledge.

Must be why the Republican judge lets rapists back into their county with a slap on the wrist, to punish those who are politically slightly less wrong than himself.

There could also be some kind of mix up. Maybe he only drugged and rapped her.

Yo yo yo what up. I told y'all I'd be back.
It's me, your dawg MC Roofie and my wife Sleepin' Suzie and tonight we're gonna drop it like it's hot!

But seriously though, we weren't at the trial. We didn't see all the evidence. When a rapist poisoner isn't thrown off the courthouse roof to be eaten by wolves, there's probably more to the story.

Sadly, I fear the more is connections and leverage on the judge.

If it makes you feel better, I have never felt that way nor have I ever heard of anyone feeling that way until the recent news barf.

People who think that should never get work. Real people need the scarce monies floating around.

My assertion was he would be from a deep blue district. My assertion was right. These no jail time cases seem to emanate from blue districts. See child rapist in colorado. Maybe he needs to be soft due to his electorate?

Please show a case like this from a deep red district. I know of many cases from blue districts.

Looks like Republicans and Democrats are guaranteed 8 spots each on the ballot, for 16 judgeships.

It's stupid shiat like this that gets mandatory sentencing laws passed.  Mandatory sentences are a bad idea, but when the good-ol-boy system allows a rapist to get off with no real punishment, people are easily convinced it is a good idea.
