Well the guy was trying to use his MassHealth card as legal identification.  Most government agencies will only let you use very specific types of ID as legal ID.  Specifically picture ID.  Do MassHealth cards come with a picture on them?

It must be nice if you live in Mexico and lose your driving privileges by drunk driving and killing a bunch of people you can just move to America and get a fresh start with a new drivers license.

Does this guy have a CDL? That should be a scandal, if he does.

There's a couple of points I'm not really clear on.

First, from TFA: "...lawyer Peter L. Ettenberg called the card extremely prejudicial to his client ... (to)the jury-waived trial."

I can see an argument against this form of ID were a jury involved, but isn't this somewhat insulting to the judge?

Second from TFA: "The defense is arguing ... that people trying to stop Mr. Guaman's truck were yelling in English but his client does not speak the language."

Um, assuming I'm not a drunken, reckless, or intentionally oblivious person... I imagine I could understand anguished screaming and wailing in less than a quarter mile of driving at non-highway speeds, regardless of the language spoken.

it's about letting it into evidence.  you only care about 1 thing, whether the jury will see it (ideally.  or, if they do, then you found problems with the jury).  if it's not evidence, then they don't see it.  the rest of the world will, but, the world is not rendering the decision.

I don't understand the issue- you don't need to be a legal US Citizen to be on Mass Health. As a Massachusetts tax payer, I am more than happy to pay for illegal immigrants health care, because I don't want tuberculosis.

But your point is still valid.  This country seems to give illegals much more than they deserve.  Driving privileges, and like in this case, benefits provided by taxes.  I'm pretty sure Ecuador isn't taking care of their American illegals this way.  In fact, gringos in Ecuador are usually targets because they bring money into the country.

In my opinion, we should give this guy a choice: Get Ecuador's government to pay for all the damage he's caused, including the entire calculated salary that man he killed would have made over his lifetime, then take him back, or let him rot in an American prison until he dies.

/Well fark, we should just let him go then. Why arrest him in the first place? Well, because he is in the country illegally, was driving drunk with his son in the car, with no license, and I'm sure he had no insurance as well. But shiat, as long as he's sorry.

What's the big deal? He will get convicted, sent to ICE for deportation, they will keep in a cell for a a day or two then let him out and tell him to come back in "a few year" so they can deport him.

It's how the Obama administration catch and release program is designed.

My uncle, a surley Viet Nam vet told me a story one time about how he was in the guard stand and saw a body fall out of helicopter and then a minute later another body fell out, the helicopter then flew off an landed back in the camp. My uncle caught up with one the crewmen later to ask what happened with the bodies falling out of the chopper. The crewmen told him they were interogating a couple of VC and they wouldnt talk to he shoved one out the door, well this caused the other one to start talking too much so he got shoved out because he wouldnt shut up.

I dont know how true it is, but it always stuck with me

Agreed. I have no problem with corporal punishment for this heartless asshole.

I will be having prison vigilante fantasies about him being sexually tortured by incarcerated motorcyclists.

Gringos are targets in latin america because they flash cash around trying to look impressive.

And, while I agree we should tighten up our borders, americans who run to latin american are usually doing it to dodge taxes, ex wives, the cops, or to fark children and get high.
