I'm wondering, the article says it was 8 years ago, and that they were teenagers.  I don't see any actual ages in the stories.  If the ball tapper was a minor, can the ball tappee's parents still sue him?

You're not going to one-up Captain Kirk, friend.  Your only real option is bagging someone that's had excess colloidal silver to be close-enough.

When I hear about groups of boys going after each others' balls, I have to make the assumption that they're all in the closet homosexuals trying to hide something.

You know, kind of like frat guys.

Anyone who adopts the behavior of the Jackass crew deserves to be rendered infertile. Sometimes the gene pool needs a little chlorine.

The parent's homeowners policy.

Expected or intended injury is excluded.  "I never meant to hurt him like that. I meant for him to be in pain for about five seconds."  By saying this, he has voided any coverage because the it doesn't matter if the degree of injury is different from what was intended.

I was tapped in the balls by a Chinese fellow in a Guangzhou post office.  He also grabbed my large American friend's large American butt.  He was wearing a white dress shirt covered with large red hearts.  He didn't even call the next day.

I don't understand why insurance is off the hook. It was an accident and he was injured.

And even if it was on purpose, does that excuse insurance? What if a burglar hit him with a pipe? That is on purpose and you would think insurance would cover it.

What I don't get is that the kid who got hurt didn't commit an intentional act and injure himself. HE didn't drive into a tree himself. He was playing a lame game in the basement and got hit from behind. If some guy shoots me in the chest while robbing me, I'd expect my insurance to pay my huge medical bills. He certainly shot me intentionally, but why the hell does that matter?

Pretty close to this.  I would never hang out with people who thought striking nuts was a fun game, and I have kids to show for it.  They must be part of a Darwin club, they'll all be removed from the gene pool one way or another.

This wasn't insurance taken out by the boy's family, they were suing the young man for the cost of the injuries and it was his insurance company let off the hook for his actions.  This means the ball striker is on his own to pay the bent piper.  So, if a burglar did the deed, he would not have his insurance company to help pay the victim.  Something about that last paragraph helps when it is read.

Welcome to farking America.

To clarify, it wasn't health insurance that was denied, if they had it was not mentioned in the article. The case was about someone (the victim or their insurance company) seeking recompnse from Hearn's (the attacker's) homeowner insurance. The home owner's insurance that fought this, and with good reason: they insure accidents, NOT intentional acts. Hearn admitted he wanted to hurt his friend (just not so badly), so the insurance refused to pay because he intentionally harmed the victim. Hearn will have to pay for the victim's medical bills.

/he will probably declare bankruptcy instead
//can't see that guy going too far in life
///if that's how he treats his friends how does he treat his enemies?

Seems bizarre that they would go after homeowners insurance when this happened at the victim's house.

Irresponsible not to have health insurance, seems like a freak accident.
