Actually, she is not.  Her estate might be depending on the contract and the state, but dead people can't be obligated to perform.  It doesn't matter anyway because this was deferred retirement money and not part of her estate.

To answer the first question, it was technically stolen from the benificiary of the account because the asset transferred the moment she died.  It just sounds more heinous if they report he stole it from her not yet cold hands.

Was gonna say something similar.  My grandpa's main checking and savings accounts were set to go directly to me on his death.  Do not pass Go, etc.  The same credit union also carried one of his credit cards.  When they contacted me to verify my address, they asked for the contact info for the trustee or executor so they could put in a claim for the balance of the credit card.  Even tho they were holding what had been his money, it was no longer his so they couldn't just take it.  Of course, I told them to just go ahead and take it out of my money because it was only around a hundred bucks and it'd just be coming out of other money I'd be getting down the road.  6 one way, half a dozen the other.
