Maybe at least the gas stations can do what I've seen done overseas: install blue lights so the heroin users cannot find a vein to inject in. Though I just read that heroin users just mark their veins beforehand with a marker. Cheeky monkeys.

DA is slipping.  Why not charge him with Burglary as he illegally entered the building to commit a felony? Sure it is a stretch, but you could make a case for it for leverage purposes. That way you get the plea for possession much easier.

To get a burglary conviction you would have to say he took something, which he didn't. That's a lot of paperwork for something that won't fly. You can't get him for possession if it's in his system. He has to possess. also he can't have entered the building illegally if the toilets are meant to be used by the public, that's not trespassing.

You need what is known as a shooting gallery, a supervised place where people can shoot up. Local businesses hate it because junkies will hang out in the area but it offloads problems like these

Actually some states have the burglary charge to be entering to commit any felony. So if I enter your locked home, don't take anything, and assault you, that can be burglary in addition to the assault.   The felony you could argue that he committed was, possession of a controlled substance that the empty bank allowed him to consume and enjoy (assuming he didn't take anything while in there).   Now of course, that isn't exactly the behavior that the legislature intended, but depending on the wording you could argue it.

Yes, the buildings and restrooms are open to the public during business hours, but by hiding in the restrooms beyond operating hours could serve as illegal entry much as if someone hid in the restroom or closet and then stole items after everyone left.  Again it depends on the wording of the statute and how case law has developed.  I was just suggesting that perhaps there was some creative yet plausible charges they could additionally pursue if only to encourage a swift resolution of the case..
